U.S. Attorney Brendan V. Johnson
announced that a Marty, South Dakota man has been indicted by a federal grand
jury for burglary and assault.
Gregory C. Provost, age 35, was indicted
by a federal grand jury on April 4, 2012 for burglary and assault with a
dangerous weapon. He appeared before U.S. Magistrate Judge John E. Simko on
April 26, 2012 and pled not guilty to the indictment. The maximum penalty upon
conviction is 15 years’ imprisonment and/or a $250,000 fine. The charges are
merely accusations, and Provost is presumed innocent until and unless proven
guilty.
The investigation is being conducted by
the Bureau of Indian Affairs, Law Enforcement Services-Yankton Agency and the
FBI. Assistant U.S. Attorney Thomas J. Wright is prosecuting the case. Provost
was remanded to the custody of the U.S. Marshals Service. A trial date has not
yet been set.
