The United States Attorney’s Office announced that during a federal court session in Billings on April 16, 2012 before Chief U.S. District Judge Richard F. Cebull, Cory Paul Clubfoot, a 30-year-old resident of Lame Deer and an enrolled member of the Northern Cheyenne Tribe of Indians, pled guilty to abusive sexual contact. Sentencing has been set for July 19, 2012. He is currently detained.
In an offer of proof filed by Assistant U.S. Attorney E. Vincent Carroll, the government stated it would have proved at trial the following:
On August 2, 2011, the victim was drinking alcohol at her house on the Northern Cheyenne Indian Reservation. There were several people at her house drinking with her, including Clubfoot.
At approximately 2:00 a.m. on August 2, 2011, Clubfoot went into one of the bedrooms to lie down. The victim stated that the next thing she remembers is waking up at a neighbor’s house, wearing only a t-shirt and underwear. She told agents that she would not have engaged in any sexual act with Clubfoot because she considers him to be her “uncle.”
Clubfoot was interviewed by law enforcement and confessed to having sexual contact with the victim during the early morning hours of August 2, 2011.
Clubfoot faces possible penalties of two years in prison, a $250,000 fine, and lifetime supervision.
The investigation was a cooperative effort between the Bureau of Indian Affairs and the Federal Bureau of Investigation.
