Eagle Butte Man Indicted for Sexual Contact with Two Victims

United States Attorney Brendan V. Johnson announced that an Eagle Butte man has been indicted by a federal grand jury for abusive sexual contact.

Frankie Delgado, age 51, was indicted by a federal grand jury on December 14, 2011. He appeared before United States Magistrate Judge Mark A. Moreno on December 16, 2011, and pled not guilty to the indictment. The maximum penalty upon conviction is two years in custody, a $250,000 fine, or both on each count. Restitution may also be ordered. The charges relate to the alleged sexual contact of two victims in the spring of 2011. The charge is merely an accusation, and Delgado is presumed innocent until and unless proven guilty.

The investigation is being conducted by the Federal Bureau of Investigation. Assistant United States Attorney Jay Miller is prosecuting the case. Delgado was released on bond pending trial. A trial date has not yet been set.
