PHOENIX, AZ—Yesterday, a grand jury returned an indictment charging Luwiza Laku Daman, Shullu Anguwi Gorado, and Asa Shani with concealment of a material fact within the jurisdiction of the Transportation Security Administration by causing a package that simulated the appearance of an explosive device to be taken into a security checkpoint without disclosing the presence of the package. A violation of Title 18, United States Code, Sections 1001 and 2.
A detention hearing is set for today for all three defendants before Magistrate Judge Michelle H. Burns at 1:30 p.m., in courtroom #303 at 401 W. Washington Street in Phoenix. The United States has moved for the pre-trial detention of all three defendants.
A conviction for violating Section 1001 carries a maximum penalty of five years, a $250,000 fine, or both. An indictment is simply the method by which a person is charged with criminal activity and raises no inference of guilt. An individual is presumed innocent until competent evidence is presented to a jury that establishes guilt beyond a reasonable doubt.
The investigation in this case was conducted by the Federal Bureau of Investigation and the Phoenix Police Department. The prosecution is being handled by Joseph Koehler, Assistant U.S. Attorney, District of Arizona, Phoenix.
