February 1, 2010 - NEW ORLEANS, LA—TODD DAGGS, age 31; RODNEY BOLTON, age 46; and LARRY ROSS, age 38, all residents of New Orleans, were charged in a second superseding indictment for one count of conspiracy to possess with intent to distribute one kilogram or more of heroin and five kilograms or more of cocaine hydrochloride, announced U.S. Attorney Jim Letten.
This second superseding indictment, which extends the previously charged heroin and cocaine conspiracy to a time before July 12, 2005 until June 4, 2009, specifically adds a multitude of charges against TODD DAGGS. DAGGS was charged with two counts of possession with intent to distribute quantities of controlled substances, including heroin and cocaine, and two counts of possessing a firearm in furtherance of a drug trafficking offense. DAGGS was also charged with being a felon in possession of a firearm. According to the second superseding indictment, the charges stemmed from conduct occurring on July 12, 2005.
There were no new substantive charges against RODNEY BOLTON or LARRY ROSS in the latest indictment. BOLTON and ROSS were each previously charged with multiple counts of using a telephone in furtherance of a drug trafficking crime. ROSS was also charged with possession with intent to distribute a quantity of heroin.
If convicted of the conspiracy each defendant faces a mandatory minimum of 10 years' to life imprisonment and at least five years' supervised release. BOLTON and ROSS face not more than four years' imprisonment and not more than one year supervised release on each of the telephone counts. ROSS faces not more than 20 years' imprisonment and three years' supervised release if convicted for possession with intent to distribute a quantity of heroin. DAGGS faces not more than 10 years' imprisonment and three years' supervised release if convicted of being a felon in possession of a firearm. DAGGS faces five-year terms of imprisonment which would run consecutive to any other term of imprisonment he received if he is convicted of having possessed a firearm in furtherance of a drug trafficking crime. DAGGS faces not more than 20 years' imprisonment if convicted of possession with intent to distribute quantities of heroin and cocaine.
Two defendants named in the original indictment pleaded guilty last year. Tehran Wills pleaded guilty to conspiracy and will be sentenced on April 21, 2010. George Murray pleaded guilty to lesser charges in a superseding bill of information and will be sentenced on February 10, 2010.
The trial in this matter is set for March 29, 2010 before the Honorable Kurt D. Engelhardt.
