February 18, 2010 - INDIANAPOLIS—Rafael Chapotin-Marfarlan, 57, an inmate with the Bureau of Prisons, was indicted by a federal grand jury today for aggravated assault on a federal officer, following an investigation by the Federal Bureau of Investigation and the Bureau of Prisons.
The indictment alleges that Chapotin-Marfarlan assaulted a correctional officer at the Federal Correctional Complex in Terre Haute, Indiana on November 10, 2009, resulting in bodily injury to the officer.
According to Assistant U.S. Attorney James M. Warden, who is prosecuting the case for the government, Chapotin-Marfarlan faces a maximum of 20 years in prison and a $250,000 fine. An initial hearing will be scheduled before a U.S. Magistrate Judge.
An indictment is only a charge and is not evidence of guilt. A defendant is presumed innocent and is entitled to a fair trial at which the government must prove guilt beyond a reasonable doubt.
