February 12, 2010 - Steven M. Dettelbach, United States Attorney for the Northern District of Ohio, today announced that a federal grand jury has returned an indictment against Timothy Lynn Miller, age 36, of Canton, Ohio, in connection with a bank robbery. The one-count indictment charges that Timothy Lynn Miller, by force, violence and intimidation, did take and attempt to take from the person and presence of a teller at Chase Bank, 632 East Market Street, Akron, Ohio, money and property belonging to and in the care, custody, control, management and possession of said bank, the deposits of which were then insured by the Federal Deposit Insurance Corporation.
The actual sentence in this case will be determined by the Court after consideration of the advisory Federal Sentencing Guidelines which depend upon a number of factors unique to each case, including the defendant’s prior criminal record, if any, the defendant’s roles in the offense and the unique characteristics of the violation. In all cases the sentence will not exceed the statutory maximum and in most cases it will be less than the maximum.
The case was presented to the grand jury by Assistant United States Attorney Daniel J. Riedl following an investigation by the Federal Bureau of Investigation, Ohio Bureau of Criminal Identification and Investigation, Akron Police Department, Alliance Police Department, Canton Police Department and Ohio Adult Parole Authority.
An indictment is not evidence of guilt. A defendant is entitled to a fair trial in which it will be the government’s burden to prove guilt beyond a reasonable doubt.
