Aggravated Felon Apprehended By South Texas CBP Agents Sent To Prison

Tucson, Ariz. – A 30-year-old Guatemalan male, apprehended by Nogales Station Border Patrol agents in May, was sentenced to 24 months in prison on Nov. 8.
 
The U.S. Attorney’s Office prosecuted Allan Yair Najera-Valenti for attempting to re-enter the United States illegally after his apprehension on May 12, 2011. During processing at the Nogales Station, the Integrated Automated Fingerprint Identification System revealed that Najera-Valenti was convicted twice in Phoenix – in 1998 and 2009. The first conviction, unlawful possession of a firearm by an illegal alien, resulted in a 15-month prison sentence. The later conviction, for misconduct involving a weapon, earned Najera-Valenti another 18 months in prison. Records also indicated Najera-Valenti was previously deported from the United States through Arizona.
 
Following initial processing, the Border Patrol submitted the case to the U.S. Attorney’s Office for re-entry of a felon. He will be formally removed from the U.S. following his 24-month incarceration.

Najera-Valenti is now banned for life from all legalization processes without a waiver from the United States Attorney General.
