Springfield Man Receives Additional Three Years in Federal Prison After Obtaining Guns and Fleeing to Mexico to Avoid Service of Prison Time

EUGENE, OR—Dale Wayne Manning, 46, of Springfield, Oregon, was sentenced on May 24, 2011 by U.S. District Judge Michael R. Hogan to serve a sentence of 37 months in prison for possessing firearms as a felon. The prison sentence was imposed to run consecutive to the 132-month prison sentence Judge Hogan imposed on March 2, 2010, following Manning's convictions for transportation and possession of child pornography. While on release pending his voluntary surrender to prison on the child pornography offenses, it was discovered that Manning was illegally in possession of two firearms, a violation of his conditions of release and a separate criminal offense since Manning was a convicted felon.

Manning was summonsed to appear before Judge Hogan in April 2010 to show cause why his release should not be revoked. Manning failed to appear at the hearing and instead fled to Mexico. A warrant was issued for his arrest. Within 24 hours of his failure to appear, the United States Marshals Service determined Manning's location in Tijuana, Mexico and advised Mexican Federal Police of Manning's location. The following day, Mexican police arrested Manning in his hotel room in Tijuana and released him to U.S. law enforcement officials. Manning was indicted for failure to appear and felon in possession of firearms, and on March 9, 2011, Manning pleaded guilty before Judge Hogan to being a felon in possession of firearms.

This case was investigated by the United States Marshal Service and the FBI, with assistance from the Bureau of Alcohol, Tobacco, Firearms, and Explosives and the Mexican Federal Police. The case was prosecuted by Assistant U.S. Attorney AnneMarie Sgarlata.
