James L. Santelle, United States Attorney for the Eastern District of Wisconsin, announced today that a federal grand jury has returned a two-count indictment against Darrell M. Schneider (age: 29) of Keshena, Wisconsin, charging him with engaging in a sexual act with an individual incapable of appraising the nature of the conduct in violation of 18 U.S.C. § 2242. These crimes occurred on the Menominee Indian Reservation. Each count has a maximum penalty upon conviction of life imprisonment and / or a $250,000 fine.
According to a criminal complaint filed in the case, in April 2011, Schneider supplied alcohol to the 15 year old victim. The complaint alleges that after she passed out, she awoke to find Schneider on top of her attempting to commit a sexual act.
The case was investigated by the Menominee Tribal Police Department and the Federal Bureau of Investigation and is being prosecuted by Assistant United States Attorney William Roach of the Eastern District of Wisconsin, Green Bay Division.
An indictment is only a charge and is not evidence of guilt. A defendant is presumed innocent and is entitled to a fair trial at which the government must prove guilt beyond a reasonable doubt.
