Two Men Convicted on Drug Trafficking Charges

February 16, 2010 - ROCHESTER, NY—Algernon Toole, 40, of Evansville, Indiana, and Everette Toole, 35, of Dolton, Illinois, were convicted after a jury trial of two counts of conspiracy to possess with intent to distribute, and to distribute, five kilograms or more of cocaine, which carry a mandatory minimum of 10 years in prison and a maximum penalty of life in prison, a fine of $4 million, or both.

Assistant U.S. Attorneys Brett A. Harvey and Charles E. Moynihan, who handled the case, stated that the defendants were involved in a drug trafficking organization that was responsible for trafficking more than 50 kilograms of cocaine from Chicago, Illinois, to the Rochester, New York area between 2003 and 2006.

The conviction was the culmination of an investigation on the part of Special Agents of the Federal Bureau, under the direction of James H. Robertson. The Rochester Police Department, under the Direction of Chief David Moore, and the Bureau of Alcohol, Tobacco, Firearms and Explosives, under the direction of Michael Lawandus, also assisted in the investigation.

Sentencing is scheduled for May 18, 2010, at 11:00 a.m. for Algernon Toole, and May 18, 2010, at 2:00 p.m. for Everett Toole, in Rochester, New York, in front of U.S. District Judge David G. Larimer.
