March 3, 2010 - Baltimore, Maryland - U.S. District Judge Catherine C. Blake sentenced Daryl Smith, age 30, of Baltimore, today to 151 months in prison followed by three years of supervised release for possession with intent to distribute heroin and possession of a gun by a felon. Judge Blake enhanced Smith’s sentence upon finding that he was a career offender based on two previous convictions for drug and assault offenses.
The sentence was announced by United States Attorney for the District of Maryland Rod
J. Rosenstein; Special Agent in Charge Theresa R. Stoop of the Bureau of Alcohol, Tobacco, Firearms and Explosives - Baltimore Field Division; Baltimore City State’s Attorney Patricia C. Jessamy; and Baltimore Police Commissioner Frederick H. Bealefeld III.
According to his plea agreement, on June 20, 2006 Baltimore City police detectives arrested a man selling drugs to several individuals in the vicinity of the 1400 block of East Lanvale Street in Baltimore City. The man fled into a residence, where Daryl Smith resided, and was apprehended. Smith was on the first floor of the residence and was detained. Detectives searched the residence and recovered cocaine and heroin packaged for distribution, over $1900 and a 9mm semi-automatic handgun containing a magazine and 15 rounds, which belonged to Smith.
Prior to June 20, 2006, Smith had been convicted of a felony and thus was prohibited from possessing a gun. Mr. Rosenstein commended Assistant U.S. Attorney John W. Sippel who prosecuted the case.
