March 26, 2010 - Steven M. Dettelbach, United States Attorney for the Northern District of Ohio, announced that Timothy McClung, 47, of Sandusky, Ohio, pled guilty on March 24 to all three counts of an indictment, which charged McClung with one count of theft concerning programs receiving federal funds and two counts of mail fraud. McClung was formerly the Chief of Police for Perkins Township, Ohio.
McClung admitted that between May 1, 2004, and April 30, 2005, he was an agent of Perkins Township, an organization that received more than $10,000 in federal funds. Perkins Township purchased and paid for multiple firearms, which McClung admitted he sold to third parties. The third parties paid McClung for the firearms, and McClung failed to return the money from the sale of the firearms to Perkins Township.
McClung also admitted that between August 30, 2006, and September 28, 2006, he devised and executed a scheme and artifice to defraud Perkins Township by selling additional firearms, purchased for the benefit of the Perkins Township Police Department, to third parties in return for payment.
The actual sentence in this case will be determined by the Court after consideration of the advisory Federal Sentencing Guidelines, which depend upon a number of factors unique to each case, including the defendant's prior criminal record, if any, the defendant's role in the offense and the unique characteristics of the violation. In all cases the sentence will not exceed the statutory maximum and in most cases it will be less than the maximum. A sentencing date has not been scheduled.
This case was prosecuted by Assistant United States Attorney Matthew B. Kall following investigation by the Federal Bureau of Investigation and Bureau of Alcohol, Tobacco, and Firearms.
