Court Affirms Former Taylor DPW Director’s Prison Sentence

April 19, 2010 - Dennis C. Pfannenschmidt, United States Attorney for the Middle District of Pennsylvania, announced today that the United States Court of Appeals for the Third Circuit has affirmed the prison sentence of Robert Sweet, age 64. Sweet was previously sentenced by U.S. District Court Judge William J. Nealon to serve 18 months in prison for accepting kickbacks for borough contracts.

Sweet pleaded guilty on July 11, 2007, to interference with commerce by extortion under color of official right. Sweet admitted to taking kickbacks totaling between $10,000 and $30,000 from the awarding of borough contacts during 2001-2006. Sweet also admitted paying contractors and taking kickbacks for work that was never performed.

The charge against Sweet resulted from an investigation by the Federal Bureau of Investigation. He was sentenced by Judge Nealon on May 9, 2008.

In appealing his sentence, Sweet claimed that the 18-month prison sentence was unreasonable. The Third Circuit Court ruled, however, that the sentence imposed by Judge Nealon was both procedurally and substantively reasonable.

Pfannenschmidt noted that the case and appeal were handled by Assistant United States Attorney Francis P. Sempa.
