SANTA CLARA, Calif. – Bureau of Alcohol, Tobacco, Firearms
and Explosives (ATF), San Francisco Field Division Acting Special Agent in
Charge Eric D. Harden announced the arrest of Juan Gutierrez.
Gutierrez, 41, of Santa Clara was arrested yesterday on
federal charges at his home. According to the criminal complaint, Gutierrez is
charged with being a convicted felon in possession of a firearm, and
manufacturing firearms without a license. In early March, ATF agents initiated
an investigation of the criminal activities of Gutierrez, who is a member of
the California State Militia, South Bay Platoon.
On this same date, ATF Agents served a search warrant at
Gutierrez’s residence, where two AR Type firearms, a pistol and a 308 rifle,
without serial numbers, and over 1000 rounds of ammunition were seized.
A criminal complaint is merely an allegation and is not
evidence of guilt. A defendant is entitled to a fair trial in which it will be
the government’s burden to prove guilt beyond a reasonable doubt. This
investigation was conducted by ATF. The case is being prosecuted by Assistant
United States Attorney, Marissa Harris.
