Norris Man Pleads Guilty to Assaulting His Father

United States Attorney Brendan V. Johnson announced that Russell F. Eagle Bear, III, age 28, of Norris, South Dakota, appeared before United States District Judge Roberto A. Lange on April 11, 2011, and pled guilty to count two of the indictment that charged him with assault resulting in serious bodily injury. The maximum penalty upon conviction is 10 years in prison, a $250,000 fine, or both; up to three years of supervised release; and a $100 special assessment. Restitution may also be ordered.

The charge relates to Eagle Bear unlawfully assaulting his father at Norris on September 4, 2010. Said assault resulted in his father receiving serious bodily injuries. The investigation was conducted by the Federal Bureau of Investigation and Rosebud Law Enforcement Services. The case is being prosecuted by Assistant United States Attorney Meghan N. Dilges.

A presentence investigation was ordered, and a sentencing date was set for July 5, 2011. The defendant was remanded to the custody of the U.S. Marshals pending sentencing.
