United States Attorney Ron Parsons announced that an Allen,
South Dakota, man has been indicted by a federal grand jury for Sexual
Exploitation of a Minor, Receipt of Child Pornography, Distribution of Child
Pornography, Sexual Abuse of a Minor, and Transfer of Obscene Material to a
Minor.
Stacey Garnette, a/k/a Stacy Garnette, age 41, appeared
before U.S. Magistrate Judge Daneta Wollmann and pleaded not guilty to the
Indictment.
The maximum penalty upon conviction is up to 30 years in a
federal prison, up to life of supervised release, and $700 to the Federal Crime
Victims Fund. Restitution may also be
ordered.
The charges relate to Garnette recording a minor female
engaged in sexually explicit conduct and sending it via Facebook Messenger with
his cellular phone connected to the Internet.
Garnette is also alleged to have engaged in a sexual act with this
juvenile female between May 2018 and January 2019, at a time when she had not
attained the age of 16 years.
The charges are merely accusations and Garnette is presumed
innocent until and unless proven guilty.
The investigation is being conducted by the Oglala Sioux
Tribe Department of Public Safety and the Federal Bureau of Investigation. Assistant U.S. Attorney Megan Poppen is
prosecuting the case.
Garnette was released pending trial, which has been set for
December 31, 2019.
