PITTSBURGH, Pa - A resident of Newark, New Jersey has been
indicted by a federal grand jury in Pittsburgh on charges of violating the
federal narcotics laws, United States Attorney Scott W. Brady announced today.
The one-count Indictment, returned on July 30 and unsealed
yesterday, named Herbert L. Felder, age 50, as the sole defendant.
According to the Indictment, in and around December 2018,
and continuing to on or about May 1, 2019, the defendant conspired to possess
with intent to distribute and distribute 400 grams or more of a mixture and
substance containing fentanyl, a Schedule II controlled substance, and 100
grams or more of a mixture and substance containing heroin, a Schedule I
controlled substance.
The law provides for a maximum total sentence of not less
than 10 years to a maximum of life in prison, a fine of up to $10,000,000, or
both. Under the Federal Sentencing Guidelines, the actual sentence imposed
would be based upon the seriousness of the offense and the prior criminal
history, if any, of the defendant.
Assistant United States Attorney Jerome A. Moschetta is
prosecuting this case on behalf of the government.
The Federal Bureau of Investigation and the Pennsylvania
State Police conducted the investigation leading to the Indictment in this
case.
An indictment is an accusation. A defendant is presumed
innocent unless and until proven guilty.
