In San Antonio this morning, federal and state authorities
arrested 25-year old Guadalupe Garcia, III, for receipt of child pornography,
announced United States Attorney John F. Bash, FBI San Antonio Division Special
Agent in Charge Christopher Combs, and Bexar County Sheriff Javier Salazar.
A federal complaint filed yesterday charged Garcia of San
Antonio, Texas, with one count of receipt of child pornography. According to
the criminal complaint, the investigation was initiated after the Bexar County
Sheriff’s Office received information from the National Center for Missing and
Exploited Children indicating an unknown subscriber uploaded multiple image and
video files associated with child pornography to his file hosting service
account. The case was then referred to the FBI San Antonio office. During the
course of the investigation, agents and task force officers with the FBI San
Antonio Child Exploitation Task Force located a device belonging to the
defendant. A preliminary forensic examination of the device revealed the
presence of child pornography.
Upon conviction, Garcia faces up to 20 years in federal
prison. He remains in federal custody pending a detention hearing which is
expected to occur next week in U.S. Magistrate court in San Antonio.
This investigation is being conducted by the FBI San Antonio
Child Exploitation Task Force which includes the Bexar County Sheriff’s Office.
Assistant United States Attorney Tracy Thompson is prosecuting this case on
behalf of the government.
It is important to note that a criminal complaint is merely
a charge and should not be considered as evidence of guilt. The defendant is
presumed innocent until proven guilty in a court of law.
