United States Attorney Ron Parsons announced that a
Bullhead, South Dakota, man has been indicted by a federal grand jury for
Involuntary Manslaughter.
Daniel Brown, age 28, was indicted on January 8, 2019. He appeared before Judge William D. Gerdes on
January 10, 2019, and pled not guilty to the Indictment.
The maximum penalty upon conviction is up to 8 years in
custody and/or a $250,000 fine, 3 years of supervised release, and $100 to the
Federal Crime Victims Fund. Restitution
may also be ordered.
According to the indictment, on or about September 8, 2018,
in Bullhead, Daniel Brown unlawfully killed another person by operating a motor
vehicle recklessly, and while under the influence of alcohol and a controlled
substance.
The charge is merely an accusation and Brown is presumed
innocent until and unless proven guilty.
The investigation is being conducted by the Federal Bureau
of Investigation. Assistant U.S.
Attorney Jeremy R. Jehangiri is prosecuting the case.
Brown was released on bond pending trial. A trial date has not been set.
