Westmoreland County Man Charged with Threatening FBI Agent

PITTSBURGH, PA—A resident of Youngwood, Pa., has been indicted by a federal grand jury in Pittsburgh on a charge of violating a federal law involving threats against a federal agent, United States Attorney David J. Hickton announced today.

The one-count indictment, returned on Jan. 31, 2012, named Anthony David Dinozzi, 44, as the sole defendant.

According to the indictment, on or about Jan. 5, 2012, Dinozzi threatened to assault and murder a special agent of the Federal Bureau of Investigation due to the performance of the agent’s official duties.

The law provides for a maximum total sentence of 10 years in prison, a fine of $250,000, or both. Under the Federal Sentencing Guidelines, the actual sentence imposed would be based upon the seriousness of the offense and the prior criminal history, if any, of the defendant.

Assistant United States Attorney Margaret E. Picking is prosecuting this case on behalf of the government.

The Federal Bureau of Investigation conducted the investigation leading to the indictment in this case.

Parker Man Indicted for Murder of 6-Month-Old Baby

PHOENIX—On January 31, 2012, a federal grand jury in Phoenix returned a two-count indictment against Brice Thompson Little, 21, a member of the Colorado River Indian Tribes, for a violation of second-degree murder of a child and assault resulting in serious bodily injury to a child.

The indictment alleges that, on March 29, 2011, while Little was living with the mother of the 6-month-old victim in Parker, Ariz., the victim was taken to the hospital with severe inflicted head injuries. After being sent to Phoenix Children’s Hospital, the victim passed away there on April 13, 2011.

A conviction for second-degree murder carries a maximum penalty of 30 years to life, a $250,000 fine, or both. In determining an actual sentence, Judge Martone will consult the U.S. Sentencing Guidelines, which provide appropriate sentencing ranges. The judge, however, is not bound by those guidelines in determining a sentence.

An indictment is simply a method by which a person is charged with criminal activity and raises no inference of guilt. An individual is presumed innocent until competent evidence is presented to a jury that establishes guilt beyond a reasonable doubt.

The investigation preceding the indictment was conducted by Colorado River Indian Tribe Police Department, the Bureau of Indian Affairs and the Federal Bureau of Investigation. The prosecution is being handled by Dyanne C. Greer and Jennifer Green, Assistant U.S. Attorneys, District of Arizona, Phoenix.

Six Fairbanks Men Arrested on Indictment for Drug Conspiracy

FAIRBANKS—United States Attorney Karen L. Loeffler announced today, February 1, 2012, that six residents of Fairbanks, Alaska, were arrested during a joint federal and state takedown. The six individuals were indicted by a federal grand jury in Anchorage on January 19, 2012, on charges of conspiracy to distribute and possess with intent to distribute powder, crack cocaine, and oxycodone pills in Fairbanks. The indictment alleges that the conspiracy began in June 2010, and continued through March 2011. The indictment detailed nearly 30 transactions involving six different named co-conspirators who had distributed illegal controlled substances.

The indictment names Martin Linenko a/k/a, “Yae Neech,” a/k/a “Neech,” a/k/a “Marty,” age 25; Cornelious Snowden, a/k/a “Bobby,” age 33; Tremain Wilson, a/k/a “Tex,” a/k/a “Lil Tex,” age 25; Johnny Toussaint, a/k/a “Blaze,” age 29; Adrian Steele, a/k/a “BG,” age 21; and Tyrone Kimble, a/k/a “Tizzy,” age 28, as defendants.

The indictment alleges that Linenko, Snowden, Wilson, Toussaint, Steele, and Kimble, all distributed crack, powder cocaine, or oxycodone pills in exchange for money between June 2010, and March 2011. The indictment alleges that members of the conspiracy attempted to conceal the illegal activities of the conspiracy by claiming the members were involved in a legitimate business, specifically, that they were “artists” or employees of local Fairbanks record labels. These record labels have business licenses held in the names of members of the conspiracy, “20 Blocc Entertainment” and “Oil Money Entertainment.”

All six defendants were arrested in the early morning hours on Wednesday, February 1, 2012. At the time of the arrests a combination of Fairbanks Police, Alaska State Troopers, University of Alaska Fairbanks Police, North Pole Police, Alaska Wildlife Troopers, Bureau of Alcohol, Tobacco, Firearms and Explosives, Federal Bureau of Investigation, United States Marshals Service, and United States Fish and Wildlife Service served federal search warrants at six separate residences in Fairbanks where all six defendants were suspected of staying. At these locations, agents found two loaded handguns, several ounces of powder cocaine, marijuana, scales used to weigh illegal narcotics, and several thousand dollars in United States currency.

The case is being prosecuted by the United States Attorney’s Office, with assistance from the Fairbanks District Attorney’s office. The law provides for a mandatory minimum sentence of five years in prison with a maximum total sentence of 40 years in prison, a fine of $5,000,000.00, or both. Under the Federal Sentencing Guidelines, the actual sentence imposed will be based upon the seriousness of the offense and the prior criminal history, if any, of the defendant.

An indictment is only a charge and is not evidence of guilt. A defendant is presumed innocent and is entitled to a fair trial at which the government must prove guilt beyond a reasonable doubt.

Meriden Man Sentenced to More Than 11 Years in Prison for Possessing Large Collection of Child Pornography

David B. Fein, United States Attorney for the District of Connecticut, announced that DAVID WAYNE PILLSBURY, 53, of Meriden, was sentenced today by United States District Judge Vanessa L. Bryant in Hartford to 135 months of imprisonment, followed by a life term of supervised release, for receiving and distributing child pornography.

According to court documents and statements made in court, on December 10, 2010, an FBI special agent in Buffalo, N.Y., acting in an undercover capacity, logged into a publicly available Internet file-sharing program and downloaded 22 images of child pornography from a shared directory maintained by PILLSBURY. On January 18, 2011, members of Connecticut Computer Crimes Task Force executed a court-authorized search and seizure warrant at PILLSBURY’s residence and seized a computer and computer components that were found in PILLSBURY’s bedroom. At that time, PILLSBURY also advised agents of the location of two hidden hard drives.

Subsequent forensic analysis of the computer components seized from PILLSBURY’s residence revealed thousands of images and videos of depicting child pornography, including images of children under the age of 12 engaging in sexually explicit conduct. PILLSBURY’s collection of child pornography exceeded 100 gigabytes in size.

On October 31, 2011, PILLSBURY pleaded guilty to one count of receipt of child pornography.

PILLSBURY has been detained since his arrest on January 18, 2011.

On July 15, 1997, PILLSBURY was convicted in the state of Washington of child molestation in the first degree, and was subsequently incarcerated for more than seven years.

This matter was investigated by the Federal Bureau of Investigation and the Connecticut Computer Crimes Task Force, which includes federal, state, and local law enforcement agencies. The Connecticut State Police have provided valuable assistance to the investigation. The case was prosecuted by Assistant United States Attorney Deborah R. Slater.

The Connecticut Computer Crimes Task Force investigates crimes occurring over the Internet, including computer intrusion, Internet fraud, copyright violations, Internet threats and harassment, and online crimes against children. The task force also provides computer forensic review services for participating agencies. The task force is housed in the main FBI office in New Haven, Connecticut. Seeking Information on “Tall, Dark, and Handsome Bandit”

The FBI Bank Robbery Task Force needs your help in identifying the man who’s being called the “Tall, Dark, and Handsome Bandit.” He was captured in bank surveillance photos robbing the Comerica Bank located at 3135 Southwest Freeway in Houston, Texas, earlier today. The bandit did not appear to be wearing a wedding ring in the photographs.

At approximately 11:55 a.m., the man entered the bank and handed a teller a threatening note which demanded money. The teller provided him with some cash, and he left the bank. No weapon was observed by witnesses. No one was physically hurt during the robbery.

The bank robber is described as a white male, mid to late 30s, 6’0”-6’1” tall, handsome, with a medium build and very short brown hair. He wore a white button-down pressed dress shirt, dress jeans, and brown sunglasses which he wore on top of his head during the robbery.

Searching for Man Who Robbed Enrichment

The Knoxville Division of the Federal Bureau of Investigation (FBI) and Chief David Rausch of the Knoxville Police Department (KPD) are asking for the public’s assistance in identifying the man who robbed a Knoxville credit union today. The suspect is believed to be the same individual who robbed the Oak Ridge National Lab Federal Credit Union located at 808 Victor Drive on December 13, 2011.

At approximately 3:20 p.m. today, the suspect entered the Enrichment Federal Credit Union located at 5201 Schubert Road in Knoxville, Tennessee, brandished a large-frame, silver handgun, and demanded money. Witnesses described the suspect as a white male, approximately 30 to 40 years old, approximately 5’10” to 6’0” tall, with a slim build. Suspect was wearing a blue fleece jacket, dark-colored baseball hat with a white Nike swoosh on the front, and dark pants. After obtaining an undetermined amount of money, the suspect left the scene in a small, dark colored sedan.

A reward is being offered for information which leads to the arrest of this individual. Anyone with information is asked to call the FBI at 865-544-0751 or the KPD at 865-215-7212. The Knoxville Division of the Federal Bureau of Investigation (FBI) and Chief David Rausch of the Knoxville Police Department (KPD) are asking for the public’s assistance in identifying the man who robbed the First Tennessee Bank today. The suspect is believed to be the same individual who robbed the First People’s Bank located at 7100 Kingston Pike on January 23, 2012.

At approximately 4:12 p.m., the suspect entered the First Tennessee Bank located at 1815 Downtown West Boulevard, Knoxville, Tennessee, brandished a black, semi-automatic handgun, and demanded money. Witnesses described the suspect as a white male in his early to mid 40s, approximately 5’10” to 6’0” tall, weighing approximately 150 to 160 pounds, with a thin build and with dark, short hair. The suspect was wearing a blue, hooded sweatshirt with “Crestridge” written in white on the front, dark blue athletic pants, and a gray cap with a snap on the brim. After obtaining an undetermined amount of money, the suspect fled the scene.

This individual has been dubbed the “The Rainbow Bandit” by the investigating agencies for the fact that he uses different color ink in his robbery notes.

The suspect enters the bank, presents a demand note, and flees.

Bank robbery is punishable by a 20-year prison sentence for each offense and increases if a dangerous weapon is used in the commission of the crime.

Secretary Napolitano Announces "If You See Something, Say Something™" Partnership with NFL for Super Bowl XLVI

INDIANAPOLIS—Secretary of Homeland Security Janet Napolitano today traveled to Indianapolis to highlight the Department’s “If You See Something, Say Something™” public awareness campaign’s continued partnership with the National Football League (NFL) to help ensure the safety and security of employees, players and fans during the regular season, and Super Bowl XLVI.

“At a major national event like the Super Bowl, security is a shared responsibility and everybody has a role to play in identifying and reporting suspicious activities and threats,” said Secretary Napolitano. “Our partnership with the NFL on the “If You See Something, Say Something™” public awareness campaign during the Super Bowl is a critical part of our efforts to ensure the safety of every employee, player and fan.”

As part of the Department's “If You See Something, Say Something™” partnership with Super Bowl XLVI, campaign graphics will appear on the videoboard and televisions throughout Lucas Oil Stadium on game day. Safety messaging will also be printed in game programs and fan guides for staff, players, and volunteers. Indiana and the City of Indianapolis have continued to expand and support the campaign over the past year since initially partnering with DHS. In addition, "If You See Something, Say Something™" advertisements will be seen throughout Indianapolis at the airport, hotels, restaurants, bars, and on buses, magazines and visitor guides.

Sterling Woman Pleads Guilty to Murder-for-Hire Plot

ALEXANDRIA, VA—Ann Jenene Cinnamon, aka Ann Jenene Greer, 41, of Sterling, Va., pled guilty today to hiring a hit man to kill her boyfriend’s “mistress.”

Neil H. MacBride, United States Attorney for the Eastern District of Virginia, and James W. McJunkin, Assistant Director in Charge of the FBI’s Washington Field Office, made the announcement after the plea was accepted by United States District Judge Liam O’Grady.

Cinnamon pled guilty to murder for hire, which carries a maximum penalty of 10 years in prison. Sentencing is scheduled for May 4, 2012.

According to court records, in August 2011 Cinnamon contacted a man to ask his help in hiring someone to murder an individual that she described as her boyfriend’s “mistress.” From that time through October 2011, Cinnamon took steps to carry out the murder, including offering to pay $500 to the hit man, paying $100 as a down payment and planning her alibi.

Court records indicate that the man she contacted brought the request to the attention of the FBI, and his interaction with the defendant was closely monitored by law enforcement. Cinnamon was arrested by the FBI on Oct. 20, 2011, following a meeting she had with the man in a Great Falls shopping center, where they discussed the murder plot and the plan for payment.

The case is being investigated by the FBI’s Washington Field Office. Assistant United States Attorney Jonathan Fahey and Special Assistant United States Attorney Melissa Pientka are prosecuting the case on behalf of the United States.

CBP Officers Arrest Delaware Fugitive at Phoenix Sky Harbor International Airport

Man was attempting to flee the country to Mexico

Phoenix– U.S. Customs and Border Protection officers assigned to Phoenix Sky Harbor apprehended a Mexican man wanted in Delaware on assault charges yesterday.

During a routine records check CBP officers found that a passenger on a flight to Guadalajara was wanted in Delaware on charges of second degree assault with a deadly weapon, and appeared to be fleeing the country. Officers stopped 27-year-old Ivan Dominguez-Guerrero in the jetway, as he was boarding the flight, and immediately took him into custody.

“The use of a law enforcement databases and intelligence by CBP officers in international ports is extremely instrumental in the apprehension of wanted and sometimes very dangerous individuals seeking to leave or enter our country,” said Port Director Cleatus Hunt. “This latest arrest highlights the important mission our officers have of safeguarding our citizens against dangerous wanted fugitives.”

Dominguez was turned over to the custody of the Phoenix Police Department pending extradition for the warrant from Delaware State Police.

U.S. Marshals Arrest York Murder Suspect in Rochester, NY

Harrisburg, PA – United States Marshal Martin J. Pane announced that yesterday the U.S. Marshals Service (USMS) arrested Richard Larry Nolden Jr., a 21-year old man originally from York, PA.

Nolden was sought by the York City Police Department for a homicide that occurred on the afternoon of Monday, January 23, 2012 on North Queen Street, near East Philadelphia Street.

The USMS adopted the fugitive case immediately and Deputy U.S. Marshals began their search for Nolden. Yesterday, those Deputies learned that he was staying in Rochester, New York. This information was forwarded to the USMS - Western District of New York. At about 5:45 PM, Deputy U.S. Marshals arrested Nolden in the 100 block of Scrantom Street in Rochester. Nolden was turned over to local authorities pending extradition to Pennsylvania.

United States Marshal Pane stated, “Historically, Marshals tracked the most dangerous fugitive wherever they fled. Today’s arrest demonstrated a modern day commitment to that same mission and our communities are safer for it.”

U.S. Marshals were assisted by several agencies that comprise its Middle District of Pennsylvania Fugitive Task Force. This included officers from the York City Police Department and the Pennsylvania State Police.

The concept of all USMS-led fugitive task forces is to seek out and arrest the nation’s most dangerous and violent offenders.

Former University of Tennessee Professor John Reece Roth Begins Serving Four-Year Prison Sentence on Convictions of Illegally Exporting Military Research Data

KNOXVILLE, TN—On January 18, 2012, John Reece Roth, a former professor of electrical engineering at the University of Tennessee (UT) in Knoxville, began serving a four-year prison sentence for his September 2008 convictions. Roth had been on bond pending his appeals, all of which were unsuccessful. He self-surrendered to the federal correctional facility in Ashland, Kentucky.

Roth was convicted after a jury trial in U.S. District Court in Knoxville, of conspiracy, wire fraud, and 15 counts of exporting “defense articles and services” without a license. As a UT professor, Roth obtained an U.S. Air Force (USAF) contract to develop plasma actuators to control the flight of small, subsonic, unmanned, military drone aircraft. During the course of that contract, he allowed two foreign national students to access export controlled data and equipment, and export some of the data from the contract on a trip to China. The Arms Export Control Act prohibits the export of defense-related materials, including the technical data, to a foreign national or a foreign nation. This case was a first-of-its-kind prosecution of a university professor for the transfer of controlled defense technology to foreign national graduate students.

The Federal Bureau of Investigation led the investigation and was joined in its efforts by Immigration and Customs Enforcement, USAF Office of Special Investigations, and Department of Commerce Office of Export Enforcement. Assistant U.S. Attorneys Jeffrey Theodore and Will Mackie represented the United States.

U.S. Attorney Bill Killian said, “This sentence communicates the importance of export compliance to academia and industry, especially in the research and development communities. It underscores the criminal consequences of non-compliance and what happens to those who knowingly and willfully violate export control laws. These federal agencies and the Assistant U.S. Attorneys are to be commended for their dedication and diligence that resulted in this sentence.”

FBI Offers Up to $5,000 Reward for Information in Fugitive Case

The FBI is offering a reward of up to $5,000 for information leading to the arrest and conviction of Rick Devan Hendrix, age 56, and Sarah Candace Deswert-Hendrix, age 30, who are wanted in connection with an alleged Internet fraud scheme. The FBI and U.S. Postal Inspection Service arrested both Hendrix and Deswert at their home in Portland, Oregon in 2005; however, they disappeared while on pre-trial release. Investigators believe Rick Hendrix, at least, may now be living in the Beaverton area.

Hendrix and Deswert face mail and wire fraud charges related to the alleged scheme. They are accused of taking pictures of items in stores, posting the items for sale on an Internet auction site, and collecting money from bidders. Victims in Oregon, Washington, and California suffered more than $300,000 in losses.

The FBI, in conjunction with Clear Channel Outdoor, is also placing information about this case on a new electronic billboard located SW 185th along Highway 26 in Washington County. The FBI, U.S. Postal Inspection Service, and the U.S. Marshals Service are working together to locate the fugitives.

Investigators Seek Information Regarding Explosives Devices Recovered in Coventry Township

Coventry Township, Ohio — The Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) is offering a reward of up to $2,500 for information leading to the arrest and conviction of the person(s) responsible for placing two illegal explosive devices near the roadway on Homewood Avenue in Coventry Township on Jan. 5, and Jan. 8.

ATF, the Summit County Sheriff’s Department and the Summit County Bomb Squad responded to the scene after being notified of these incidents. Investigators are analyzing evidence collected and are actively pursuing investigative leads. ATF and police are seeking information from the public that may assist in solving this case.

“While the devices did not detonate, the placement of such illegal devices posed a significant danger to the community and to law enforcement personnel who responded to the scene,” said Lance Kimmell, ATF Supervisory Special Agent of Cleveland Group I. “Thankfully no one was injured. We ask the community to provide any information that would lead investigators to the individual(s) responsible.”

CBP Officers at Pharr Import Lot Seize $876,000 worth of Meth in Truck Carrying Cucumbers

Pharr, TX - U.S. Customs and Border Protection officers at the Hidalgo/Pharr/Anzalduas Port of Entry this weekend seized $876,000 in methamphetamine hidden in a commercial truck.

The seizure occurred on Jan. 27 during an examination conducted at the Pharr-Reynosa International Bridge import lot. A CBP officer referred a 1998 Kenworth tractor hauling a utility trailer with a shipment of cucumbers for a secondary examination. CBP officers performed an intensive examination and discovered 23 packages containing a total of 58 pounds of methamphetamine hidden within the trailer.

The methamphetamine has an estimated street value of $876,000. CBP officers seized the narcotics and the tractor trailer.

“This is a significant interception of hard narcotics not typically encountered in the commercial environment,” said Efrain Solis, CBP Port Director, Hidalgo/Pharr/Anzalduas. “Our officers are to be commended for their continued ability to detect narcotics while facilitating lawful commerce at the Pharr import lot.”

Alabama Man Pleads Guilty to Production of Child Pornography

WASHINGTON – An Alabama man who was employed as a security officer in the Birmingham, Ala., City Schools system pleaded guilty today to one count of production of child pornography, announced U.S. Attorney for the Northern District of Alabama Joyce White Vance, Assistant Attorney General Lanny A. Breuer of the Justice Department’s Criminal Division, Northern District of Alabama FBI Special Agent in Charge Patrick J. Maley and Birmingham Police Chief A.C. Roper.

Michael Wayne Wooten, 60, of Alabaster, Ala., pleaded guilty before U.S. District Judge Inge P. Johnson in the Northern District of Alabama.

According to court documents and proceedings, between August 2009 and April 2010, Wooten, while employed as a security officer for the Birmingham City Schools system, used an office at Dupuy Elementary School to take modeling photos of numerous minor girls. A search of Wooten’s residence yielded multiple computers containing child pornography images, including images produced by Wooten depicting several victims, between four and nine years of age, engaged in sexually explicit conduct.

Wooten faces a mandatory minimum sentence of 15 years in prison and a maximum sentence of 30 years in prison, as well as the possibility of lifetime supervised release. Wooten also faces a fine of $250,000.

This case was investigated by the FBI and the Birmingham Police Department. This case was prosecuted by Assistant U.S. Attorney Daniel Fortune of the Northern District of Alabama and Trial Attorney Jeffrey H. Zeeman of the Child Exploitation and Obscenity Section in the Justice Department’s Criminal Division.

FBI Seeks Public’s Assistance Locating Two Fugitives Wanted for Several Murders, Robbery, and Racketeering, Among Other Charges

Early this morning, FBI agents and NYPD detectives arrested a number of members of the Folk Nation Gang in Brooklyn. Two of those subjects are now at large and the FBI is seeking the public’s assistance in locating them.

Devon Rodney, aka D-BLOC, aka Devon Nias, aka Devon Rodriguez, is one of the leaders of this violent gang. He is 6’ tall, 200 pounds, with brown eyes, and black hair. He is 24 years old and has a tear drop tattoo under his right eye. He is known to frequent Flatbush and the Bedford-Stuyvesant neighborhoods of Brooklyn.

The second subject, Rahleek Odom, aka RAH, aka Ralik Odom, is another member of the gang. He is 5’8” tall, 230 pounds, with brown eyes, and black hair. He is 19 years old and is known to frequent the Ebbets Field neighborhood in Brooklyn. Odom was also recently released from prison.

A significant reward is available for a tip that leads to an arrest. Anyone with information is asked to call the FBI immediately at 212-384-1000. As always, tipsters may remain anonymous.

Hartford Heroin Dealer Sentenced to More Than Six Years in Federal Prison

David B. Fein, United States Attorney for the District of Connecticut, announced that RAFAEL RODRIGUEZ, 34, also known as “Ralphie,” was sentenced today by United States District Judge Mark R. Kravitz in New Haven to 80 months of imprisonment, followed by five years of supervised release, for distributing heroin and for violating the conditions of his supervised release from a prior federal conviction.

According to court documents and statements made in court, in December 2010 and January 2011, an individual working with law enforcement made controlled purchases of heroin from RODRIGUEZ and his cousin, Jocelyn Perez. The investigation revealed that RODRIGUEZ was using 146 Mark Twain Drive in Hartford, where Perez resided with her four minor children, to store, process, and package heroin.

On January 7, 2011, a court-authorized search of the Mark Twain Drive residence revealed 3482 bags of heroin from a second floor closet, approximately 77 grams of heroin hidden in a bag of rice in a kitchen cabinet, and assorted paraphernalia associated with the processing and packaging of heroin.

On September 6, 2011, RODRIGUEZ pleaded guilty to one count of conspiracy to distribute and to possess with intent to distribute 100 or more grams of heroin.

On October 19, 2000, RODRIGUEZ was sentenced in U.S. District Court in Connecticut to 120 months of imprisonment and five years of supervised release, for conspiring to possess with intent to distribute one kilogram or more of heroin. He was released from the Bureau of Prisons on November 1, 2007, and was on supervised release in January 2011.

Perez has pleaded guilty to one count of possession with intent to distribute 100 grams or more of heroin. She awaits sentencing.

This matter was investigated by the Federal Bureau of Investigation’s Northern Connecticut Violent Crime and Gang Task Force Task Force, which includes representatives of the FBI, Connecticut State Police and Hartford Police Department.

This case is being prosecuted by Assistant United States Attorney Brian P. Leaming.

Michigan Man Charged with Making Threats to Superdome

NEW ORLEANS—SHAWN H. PAYTON, age 34, a resident of Jackson, Michigan, who was recently charged by criminal complaint in the Eastern District of Louisiana with sending threatening communications through interstate commerce, was arrested today by the FBI in Michigan announced U.S. Attorney Jim Letten.

According to public court documents, on January 7, 2012, at approximately 9:15 p.m., during the nationally televised National Football League (NFL) playoff game between the New Orleans Saints and the Detroit Lions, a threatening phone call was received by the Superdome reception desk. A male caller called the reception desk and asked the receptionist if this was the arena where the New Orleans Saints play. The receptionist stated that it was, and the caller responded that there was a bomb in the building. At this time, the Superdome was filled with over 70,000 people attending the game. A second call came into the Gate F reception desk at approximately 10:00 p.m. The receptionist noticed “7000‑3” on the caller identification, indicating a blocked call. The recorded call obtained from Superdome Information Technology Department confirmed a male caller stated, “Hi, I want you to relay a message to the sideline, if your stupid Southern team keeps winning, there will be reper...severe consequences, okay?” Subsequent investigation by the FBI revealed the caller to be SHAWN H. PAYTON of Jackson, Michigan.

PAYTON made his initial appearance before a United States Magistrate in Detroit today. He was released on bond and ordered to appear in the Eastern District of Louisiana on February 14, 2012.

If convicted, PAYTON faces a maximum term of five years’ imprisonment, and a $250,000.00 fine.

This case is being investigated by the Federal Bureau of Investigation and prosecution is being handled by Assistant United States Attorney Greg Kennedy.

Off Duty Border Patrol Agent Remains Vigilant

Over a Million Dollars Worth of Marijuana Seized

Tucson, Ariz. – An off-duty Border Patrol agent called in a tip Saturday on what he believed to be bundles of marijuana being loaded into a vehicle near State Road 86.

Agents working with surveillance equipment and an Air and Marine helicopter were able to confirm the activity. When agents arrived at the location, they discovered a Chevrolet Suburban, an ATV and just over one ton of abandoned dope wrapped in 88 individual bundles. The area was searched, but no arrests were made in conjunction with the smuggling attempt.

The Suburban had been reported stolen and was turned over to the Tohono O’odham Police Department. The ATV will be processed for seizure by the Ajo station. The 2,173 pounds of marijuana, worth an estimated $1,086,500, will be turned over to the Drug Enforcement Administration.

“Our agents continue to be vigilant even when off duty,” said Tucson Sector’s Deputy Chief Patrol Agent Manny Padilla. “Thanks to our agents, our law enforcement partners and local citizens who alert us to suspicious activity, we can continue to help make our communities safer.”

Two Plead Guilty to Warwick Bank Robbery

PROVIDENCE, RI—A Providence man and woman arrested a short time after robbing a Warwick bank and then fleeing in a taxi have pled guilty to federal bank robbery charges announced U.S. Attorney Peter F. Neronha, Warwick Police Chief Colonel Stephen M. McCartney, and Richard DesLauriers, Special Agent in Charge of the FBI’s Boston Field Office.

Anthony Miller, 24, and Christine Halverson, 37, pled guilty as charged to conspiracy and bank robbery charges and face sentences of up to 25 years in federal prison followed by up to six years of supervised release and a fine of up to $500,000.

Miller pled guilty on Monday and is scheduled to be sentence by U.S. District Court Judge William E. Smith on April 27, 2012. Halverson pled guilty on December 20, 2011, and is scheduled to be sentenced by Judge William E. Smith on March 23, 2012.

At the time of their guilty pleas, Miller and Halvorsen admitted to the court that on August 30, 2011, they entered a Citizens Bank branch office together and demanded cash from two tellers. Miller admitted that he presented a note to a bank teller demanding cash. Halvorsen admitted that at the same time she verbally made the same demand of a second teller. The pair fled the bank with approximately $1,900.

According to information presented to the court, bank employees provided police with a description of a taxi in which the pair fled the bank after the robbery. A short time later, a Warwick Police sergeant who heard a police radio broadcast of a description of the taxi observed a vehicle matching that description stopped in traffic. As the officer exited his police vehicle and approached the taxi, Miller fled from the taxi but was quickly chased down by the officer and arrested. Halvorsen exited the taxi cab but was quickly detained.

Warwick officers recovered a large quantity of cash from the roadway in the area of the taxi the two were riding in. Several other items tying Miller and Halvorsen to the robbery were also recovered in and around the taxi.

Miller and Halverson have been detained since their arrest. Their cases are being prosecuted by Assistant U.S. Attorney Stephen G. Dambruch.

The matter was investigated by Warwick Police and the Federal Bureau of Investigation.

South Florida Corrections Officers Sentenced on Federal Civil Rights and Obstruction Charges

MIAMI—Two corrections officers were sentenced to prison today for civil rights and obstruction charges stemming from prisoner abuse that took place at the South Florida Reception Center (SFRC), a state prison in Doral, Fla., the Justice Department announced. Florida Department of Corrections (FDOC) Sergeant Alexander McQueen, 31, was sentenced by U.S. District Court Judge Cecilia Altonaga to serve one year in prison, followed by one year of supervised release. Judge Altonaga also sentenced FDOC Officer Steven Dawkins, 31, to serve one month in prison, followed by six months of supervised release.

On Oct. 17, 2011, following a jury trial, McQueen was found guilty of conspiracy against civil rights and obstruction of justice for his involvement in, and attempts to cover up, prisoner abuse at SFRC. The same jury convicted Dawkins of obstruction of justice. A second jury was unable to reach a verdict with regard to co-defendant Guruba Griffin, 31, and acquitted co-defendant Scott Butler, 32.

According to evidence presented at trial, on Feb. 25, 2009, SFRC corrections officers physically abused inmates by choking, punching, and striking them with wooden broom handles. The officers further forced the inmates to fight one another. Additionally, McQueen and Dawkins falsified reports relating to these incidents.

“Conduct by corrections officers who abuse their power and violate the civil rights of those in their custody will not be tolerated,” said Thomas E. Perez, Assistant Attorney General for Civil Rights. “The Justice Department will continue to vigorously prosecute those who cross the line to engage in acts of criminal violence and obstruction.”

U.S. Attorney Wifredo A. Ferrer stated, “The U.S. Attorney’s Office is committed to prosecuting civil rights violators, especially when they seek to hide behind color of law or official position.”

“We are pleased with the sentence for McQueen and Dawkins because their actions affected more than those they physically abused, they undermined the public’s trust in law enforcement,” said Special Agent in Charge John V. Gillies of the FBI Miami Division. “Even though they participated in and attempted to cover up prisoner abuse at the Florida Department of Corrections’ South Florida Reception Center, they failed. The FBI will continue to work with our partners to remove those corrections officers who cross the line to engage in criminal misconduct.”

Co-defendant Griffin entered a guilty plea to one count of deprivation of rights under color of law on Dec. 13, 2011, and is scheduled to be sentenced on Feb. 22, 2012.

This case was investigated by the FBI and the Inspector General’s Office, Florida Department of Corrections, and is being prosecuted by Assistant U.S. Attorney Susan Rhee Osborne of the U.S. Attorney’s Office for the Southern District of Florida and Senior Litigation Counsel Gerard Hogan and Trial Attorney Henry Leventis of the Civil Rights Division.

FBI Seeks Serial Bank Robber

The Charlotte Division of the FBI is seeking assistance to identify a subject responsible for two recent bank robberies in the Greenville, North Carolina area. Surveillance photos from the robberies show the same individual is responsible for robbing the East Carolina Bank located at 305 7th Street in Creswell, NC on January 6, 2012, and the RBC Bank located at 113 South Main Street in Colerain, NC on January 27, 2012.

In both robberies, the subject was armed with a silver revolver. The subject is described as a black male, 20-30 years old, approximately 6’ tall, 175-200 lbs. He wore a dark-colored cap with what appeared to be fake dreadlocks. The getaway car is believed to be a white Toyota Corolla or Camry and it is missing a hubcap. There is no description available on the person driving the getaway car.

Seven Members, Associates, and Leaders of Folk Nation Gang Indicted for Racketeering and Murder

A superseding indictment was unsealed in federal court in Brooklyn this morning charging seven members, associates, and leaders of the violent Brooklyn street gang “Six Tre Outlaw Gangsta Disciples Folk Nation,” also known as the “Folk Nation.” The 16-count indictment charges the defendants with violent crimes including racketeering, murder in-aid-of racketeering, murder conspiracy, attempted murder, robbery, assault, and illegal use of firearms.1 Two defendants will be arraigned later today before United States Magistrate Judge Marilyn D. Go at the federal courthouse in Brooklyn. The defendants face sentences up to life imprisonment if convicted.

The charges were announced by Loretta E. Lynch, United States Attorney for the Eastern District of New York; Janice K. Fedarcyk, Assistant Director in Charge, Federal Bureau of Investigation, New York Field Office; and Raymond W. Kelly, Commissioner, New York City Police Department. As detailed in the indictment and other court filings submitted by the government, a two-year joint investigation by the FBI and the NYPD revealed that since 2008, a violent set of the Folk Nation gang committed numerous crimes of violence including four murders, three attempted murders, two assaults, and six robberies. The gang was based in the Ebbets Field Houses, a New York City public housing community, although its criminal activities extended into the Tri-State area.

The gang is alleged to have used extreme and indiscriminate violence to further its objectives. The defendants’ victims include a 10-year-old girl, who was severely injured when she was shot in the neck by gang members while they were attempting to murder a rival. The gang is alleged to have committed four murders, in an effort to assert its power over the neighborhoods in which it operated. On at least two occasions, gang members missed their intended targets and hit innocent bystanders—after one murder at a teenager’s birthday party in an Ebbets Field apartment, gang members acknowledged that they had killed the wrong person.

In order to fund its illegal activities, members of the gang allegedly committed violent robberies of individuals and commercial establishments. Members of the gang are alleged to have robbed the Lee Perla jewelry store at the Riverside Square Mall in Hackensack, New Jersey, making off with hundreds of thousands of dollars worth of luxury watches. According to the indictment, the gang also targeted individual robbery victims, whom they lured to secluded areas in Brooklyn, via Internet advertisements on Craigslist, and then robbed at gunpoint. According to a detention memorandum filed by the government, the charged murders and other acts of violence took place on public streets, in front of personal residences, and even on a playground, in Brooklyn neighborhoods.

The charges announced today are the latest in a series of federal indictments in this district charging members of violent street gangs with racketeering crimes.

“Motivated by greed, the Folk Nation employed indiscriminate violence to destroy the lives of their perceived enemies. But their violence spread beyond the gang world into the streets and playgrounds of Brooklyn, and innocent bystanders, including a child, were caught in the crossfire. Terrorizing a community, this gang claimed its turf by force and robbed from businesses and individuals alike leaving a trail of victims in its wake,” stated United States Attorney Lynch. “We are steadfast in our commitment to dismantling street gangs that put at risk the members of our community, and the seriousness of today’s charges reflect that commitment.”

“The reason the FBI places such a high priority on gang investigations is the extreme violence gangs so often commit. Here, as charged in the indictment, the defendants’ ruthlessness was matched by their recklessness. They allegedly showed no apparent concern for bystanders, and bystanders were seriously hurt as a consequence,” said Assistant Director in Charge Fedarcyk.

NYPD Commissioner Kelly stated, “Through a variety of partnerships, including clergy, the Brooklyn District Attorney, and in this case United States Attorney Loretta Lynch, the police department is suppressing crime in Brooklyn to the point where last year for the first time since 1963 murder in the Borough fell below 200. As charged in the indictment, members of the Folk Nation have been responsible for multiple murders and shootings, and their apprehension and prosecution should have a continued salutary effect for the residents in and around the Ebbets Field Houses.”

The government’s case is being prosecuted by Assistant United States Attorneys Zainab Ahmad and Seth DuCharme.

Joint Operations Net $1.4 Million in Marijuana

Border Patrol and Homeland Security Investigations Collaborate to Thwart Smugglers

Tucson, Ariz. – Agents from the Tucson Sector Border Patrol and Immigration and Customs Enforcement’s Homeland Security Investigations, working jointly, arrested two smugglers and seized 2,805 pounds of marijuana worth an estimated $1,402,000 over the past week.

Ajo and Casa Grande Border Patrol agents conducting joint operations with HSI agents near Stanfield, Ariz., discovered an abandoned pick-up truck loaded with 42 bundles of marijuana. The vehicle was stopped on the side of the road but still running. Stacked in the cab and in the bed of the truck, agents found 947 pounds of marijuana worth an estimated $473,500. The truck and drugs were seized and processed.

In a second incident, Ajo agents received information from HSI concerning a group of suspected narcotics smugglers moving through the west desert. Agents on horseback, supported by CBP air assets, responded to the area and discovered two smugglers and a vehicle loaded with 101 bundles of marijuana. The vehicle and 1,858 pounds of narcotics, valued at approximately $929,000, were seized and processed. The smugglers are in custody facing federal prosecution on drug charges.

The Border Patrol continuously works with federal, state and local partners to reduce crime and improve the quality of life in Arizona communities. Combined efforts and intelligence-sharing has made it increasingly difficult for smugglers to operate with impunity and transport their contraband throughout the United States.

Ohio Man Sentenced to 35 Years in Prison for His Participation in an Online Child Pornography Bulletin Board

WASHINGTON – An Ohio man was sentenced today in Riverside, Calif., to 35 years in prison and lifetime supervised release for his participation in an online child pornography bulletin board, announced Assistant Attorney General Lanny A. Breuer of the Justice Department’s Criminal Division, U.S. Attorney André Birotte Jr. of the Central District of California and Assistant Director in Charge Steve Martinez of the FBI’s Los Angeles Field Office.

Billy Wade Carroll of Dayton, Ohio, was sentenced by U.S. District Judge Virginia A. Phillips. In October 2011, Carroll, 51, was found guilty of one count of conspiracy to advertise, solicit, transport, distribute, receive and possess child pornography and one count of committing a child pornography offense while being required to register as a sex offender in Ohio.

Today’s sentencing is the result of an international investigation into the “Lost Boy” online bulletin board. The Lost Boy bulletin board, according to court documents and proceedings, was dedicated to men who have a sexual interest in young boys and was established to provide a forum to trade child pornography.

Evidence presented at trial established that from at least September 2007 until January 2009, Carroll was an active member of the bulletin board and made more than 100 posts. He supplied images of child pornography for other members to download and also made requests on the board seeking out particular images to help supplement his child pornography collection.

Federal authorities, working in conjunction with a coalition of international law enforcement agencies, shut down the Lost Boy bulletin board approximately three years ago. As a result of the investigation, 16 named defendants were charged in the United States and arrested for their roles in the bulletin board. To date, 15 defendants have pleaded guilty or have been convicted at trial, and one defendant died in custody. Approximately six more men have been charged with child molestation as a result of the investigation. The investigation also led to the identification of 27 domestic victims of child abuse, some of whom were portrayed in images posted to the Lost Boy bulletin board.

According to court documents and proceedings, law enforcement authorities discovered the Lost Boy bulletin board after receiving information from Eurojust, the judicial cooperation arm of the European Union. Eurojust provided U.S. law enforcement with leads obtained from Norwegian and Italian authorities indicating that a North Hollywood, Calif., man was communicating with an Italian national about child pornography and how to engage in child sex tourism in Romania. Acting on the information from Europe, the FBI executed search warrants that led to the discovery of the Lost Boy network. Further investigation revealed that Lost Boy had 35 members, 16 of whom were U.S. nationals. Other members of the network were located in countries around the world, including Belgium, Brazil, Canada, France, Germany, New Zealand and the United Kingdom.

According to court documents, Lost Boy had a thorough vetting process for new members, who were required to post child pornography to join the organization. Once accepted, members were required to continue posting child pornography to remain in good standing and to avoid removal from the board. According to court documents, Lost Boy members advised one another on techniques to evade detection by law enforcement, which included using screen names to mask identities and encrypting computer data.

International law enforcement efforts involving European law enforcement, the Brazilian Federal Police and other agencies have identified child molestation suspects in South America, Europe and New Zealand. Three suspects in Romania, one in France and another in Brazil have been charged, and offenders have been convicted in Norway and the United Kingdom. Law enforcement have also identified dozens of child victims located in Norway, Romania, Brazil and other nations.

The investigation into the Lost Boy bulletin board was led by the FBI and the U.S. Postal Inspection Service, in conjunction with the Los Angeles-based Sexual Assault Felony Enforcement (SAFE) Team. The High Technology Investigative Unit of the Child Exploitation and Obscenity Section (CEOS) in the Justice Department’s Criminal Division, along with Eurojust, have provided invaluable assistance during the investigation.

New Haven Man Sentenced to More Than Seven Years in Federal Prison for Distributing Crack

Fein, United States Attorney for the District of Connecticut, announced that TORRENCE JONES, 33, of New Haven, was sentenced today by Senior United States District Judge Ellen Bree Burns in New Haven to 87 months of imprisonment, followed by three years of supervised release, for distributing crack cocaine.

This matter stems from a joint law enforcement investigation conducted by the FBI New Haven Safe Streets Task Force, the DEA New Haven Task Force, the New Haven Police Department, and the Hamden Police Department. Through the use of court-authorized wiretaps, investigating officers identified and dismantled a large drug-trafficking organization that was centered in the Newhallville section of New Haven and Hamden, and was responsible for the distribution of crack cocaine and cocaine throughout the Greater New Haven area.

According to court documents and statements made in court, from June 2010 through August 2010, JONES was intercepted several times over a wiretap ordering distribution quantities of crack cocaine from other members of the drug trafficking organization, which he then sold to his own customer base for profit.

On July 14, 2011, JONES pleaded guilty to one count of conspiracy to possess with intent to distribute cocaine base (“crack cocaine”).

Forty-seven individuals have been charged in federal court with various narcotics offenses as a result of this investigation.

U.S. Attorney Fein noted that federal prisoners are required to serve at least 85 percent of their sentenced term of imprisonment and are not eligible for parole.

This matter was investigated by the Federal Bureau of Investigation’s New Haven Safe Streets Task Force (composed of members of members of the New Haven, Ansonia, Milford, Hamden, and East Haven Police Department, and the Connecticut State Police and the Connecticut Department of Correction), the Drug Enforcement Administration’s New Haven Task Force (composed of members of the New Haven, West Haven, Meriden, Ansonia, Hamden, and Branford Police Departments), along with substantial participation by members of the New Haven and Hamden Police Departments. The United States Marshals Service also has assisted the investigation.

The investigation was funded in significant part by the United States Attorney’s Office Organized Crime Drug Enforcement Task Force and supported by the Office’s Project Safe Neighborhoods and Anti-Gang programs.

Fort Wingate Man Sentenced to 24 Months in Prison for Federal Assault Conviction

ALBUQUERQUE—This morning in federal court in Albuquerque, Andre Francisco, 24, an enrolled member of the Navajo Nation who resides in Fort Wingate, N.M., was sentenced to a 24-month term of imprisonment to be followed by three years of supervised release for an assault conviction. While on supervised release, Francisco will be required to participate in a substance abuse treatment program with testing compliance and to refrain from use of alcohol.

U.S. Attorney Kenneth J. Gonzales said that Francisco was indicted on January 28, 2011, and charged with (1) assault with a dangerous weapon, and (2) assault resulting in serious bodily injury. According to court records, on the afternoon of August 27, 2010, Francisco and his victim, also a Navajo man, became intoxicated and argued over ownership of an alcoholic beverage. The argument ended when Francisco slashed the victim’s face with a 12” steak knife. As a result of Francisco’s assault, the victim sustained a deep cut to the left side of his face that runs from the top of his ear to the left corner of his mouth.

On August 15, 2011, Francisco pled guilty to count two of the indictment, and admitted slashing the victim’s face with a steak knife in August 2010. Francisco was remanded into federal custody after entering his guilty plea.

Pursuant to the terms of the plea agreement, count one was dismissed after Francisco was sentenced.

The case was investigated by the Federal Bureau of Investigation and the Navajo Nation Department of Public Safety, Crownpoint Division, and is being prosecuted by Assistant U.S. Attorney Paul H. Spiers.

Murder-for-Hire Plot Leads to Six-Year Federal Prison Sentence

LOS ANGELES—A Santa Barbara County man who solicited a “hitman” to murder a Bel-Air man, his wife, and a business associate was sentenced today to 72 months in federal prison for orchestrating a murder-for-hire plot that stemmed from a decade-old business dispute.

Eugene Darryl Temkin, 51, of Goleta, California, received the six-year sentence from United States District Judge Stephen V. Wilson.

Following a bench trial in August, Judge Wilson found Temkin guilty of soliciting a crime of violence, attempting to interfere with interstate commerce by threats and violence, and using interstate commerce facilities in the commission of a murder-for-hire.

“The evidence showed that defendant engaged in criminal conduct of the worst sort: With meticulous planning and full contemplation, defendant agreed to pay a hitman, ‘Pavel’ [who was actually an undercover law enforcement officer], to brutally kill in cold blood three people, two of whom he barely knew,” prosecutors wrote in a sentencing brief. “What is more, these killings were only to take place after ‘Pavel’ first tortured the victims in order to force them to pay $15 million into defendant’s off-shore bank account.”

The investigation began in late 2009 when a source provided information to law enforcement indicating that Temkin planned to hire a professional killer to murder his former business partner. Over the following several months, undercover law enforcement personnel, posing as professional killers for hire, met with Temkin to discuss how the plot should be carried out. Temkin told the “hitmen” that the victim should be forced to pay $15 million to compensate Temkin for losses he believed he had sustained when a business deal to open a casino in Africa fell apart. Throughout the undercover meetings, Temkin proposed and planned various forms of murder, torture, and rape to be exacted on the victims in order to force them to pay him millions of dollars. Prior to his meetings with the undercover officers, Temkin had for almost 10 years harassed and threatened the victims. The harassment included hacking into their e-mail, stealing their personal belongings, and obtaining the victims’ personal information, including photographs and information about their children.

During the final undercover meeting with a purported “hitman” on July 8, 2010 in Encino, Temkin paid the undercover agent $3,000, which was the first installment of a $30,000 fee to extort and murder the victims. According to the plan agreed on by Temkin and the undercover agent, the extortion and murders were to be carried out in Spain, where Temkin believed the victims were vacationing. During this meeting, Temkin provided the undercover agent with, among other things, photographs of the victims, their address in Spain, and their identifying information, such as Social Security numbers and dates of birth. Temkin also gave the undercover agent information he would need to deposit the $15 million extortion payment into a bank account Temkin had control of in Uruguay.

Temkin has been held without bond since his arrest in the summer of 2010.

The investigation in this case was conducted by Detectives with the Los Angeles County Sheriff’s Department and Special Agents with the Federal Bureau of Investigation.

Former Suburban Massage Parlor Operator Convicted of Human Trafficking of Four Women in Illinois

CHICAGO – A federal jury today convicted Alex Campbell, 45, a northwest Chicago suburban massage parlor owner, of various federal crimes including sex-trafficking, forced labor, harboring illegal aliens, confiscating passports to further forced labor and extortion involving four foreign women whom he mentally and physically abused while forcing them to work for him between July 2008 and January 2010. Campbell was found guilty of three counts each of forced labor, harboring illegal aliens for financial gain, and confiscating passports and other immigration documents to force the victims to work, and one count each of sex trafficking by force and extortion. The jury deliberated approximately two to three hours beginning last Thursday afternoon following a three-week trial in U.S. District Court. The trial showed that Campbell, who formerly operated the Day and Night Spa on Northwest Highway in Mt. Prospect, Ill., used violence and threats of violence to force three women from the Ukraine and one from Belarus to work for him without pay and, at times, little to no subsistence.

Campbell, also known as “Dave” and “Daddy,” formerly of Glenview, Ill., remains in federal custody without bond and faces a mandatory minimum sentence of 15 years in prison and a maximum of life on the sex-trafficking count alone, as well as prison terms ranging from a maximum of 5 to 20 years on each of the remaining counts.

U.S. District Judge Robert Gettleman scheduled a hearing on post-trial motions for April 19, 2012. No date was immediately set for sentencing.

“The Civil Rights Division is committed to bringing human traffickers to justice and to protecting the victims of modern-day slavery,” said Thomas E. Perez, Assistant Attorney General for the Civil Rights Division. “These crimes against the individual rights of the most vulnerable members of our society will not be tolerated in the United States.”

“I commend the prosecutors and investigators for their dedication and teamwork in working with the victims to bring this case to trial and achieve a successful result,” said Patrick J. Fitzgerald, U.S. Attorney for the Northern District of Illinois.

“Forced labor and sex trafficking preys upon vulnerable women and is tantamount to modern-day slavery,” said Gary J. Hartwig, Special Agent-in-Charge of ICE Homeland Security Investigations (HSI) in Chicago. “The jury has vindicated the rights of four women who suffered mental and physical abuse, sexual exploitation, extortion and threats of deportation, all so Alex Campbell could make a profit. HSI is at the forefront of the government's fight against human trafficking. We will continue to work with our law enforcement partners to combat this serious crime.”

All four victims testified as government witnesses at trial, as well as co-defendant, Danielle John, 25, who pleaded guilty before trial to two counts of harboring illegal aliens for financial gain and is also awaiting sentencing.

The testimony and evidence showed that Campbell recruited and groomed foreign women without legal status in the United States to become part of his “Family,” which he claimed was an international organization that would provide them with support. He offered them jobs in his massage parlor, a place to live, assistance with immigration and lured each of them to enter into a romantic relationship with him. After gaining their trust, he forced the victims to get tattooed with his moniker, which he said made them his property and allowed him to stop paying them. At the same time, he acquired the women’s passports and visas. The women were forced to work long hours every day and do as Campbell instructed them, and they were beaten and punished if they disobeyed him.

Trial testimony established that Campbell confiscated passports and identity documents from three of the victims, as well as harbored and transported them to ensure their continued labor. Campbell forced one victim to engage in commercial sex acts with customers at various other massage parlors, but not at the Day and Night Spa, which testimony showed he operated “cleanly” to avoid problems with law enforcement. He extorted another victim to pay him more than $25,000 to leave the “Family” by threatening to send a sexually-explicit video recording to her parents in Belarus.

The Cook County State’s Attorney’s Office assisted in the investigation, which was coordinated by the Cook County Human Trafficking Task Force. The task force, together with the Salvation Army Family and Community Services STOP-IT Initiative Against Human Trafficking, operate a toll-free hotline, (877) 606-3158, which victims of trafficking or those with information about human trafficking can call for assistance. Overland Park Man Pleads Guilty to Producing Child Pornography

KANSAS CITY, KS—A Shawnee Mission man has pleaded guilty to a charge of producing child pornography, U.S. Attorney Barry Grissom said today.

In his plea, Steven Miller, 30, Shawnee Mission, Kan., admitted that investigators found child pornography he produced on computer hard drives. The photos showed Miller sexually abusing a 3-year-old boy. The abuse took place in 2003 while Miller was living in Overland Park, Kan.

Sentencing is set for April 19. The parties have agreed to recommend a sentence of 15 years in federal prison without parole.

NEW ORLEANS—MELVIN HUDSON, age 26; JERMAINE HUDSON, age 25; TRAVIS HUDSON age 29; MOSES LAWSON, age 27; MONTERIO WIGGINS, age 27; RODERICK WIGGINS, age 22; DANTE CARSON, age 21; DWIGHT CARSON, age 22; TOREY RICHARDSON, age 21; TEDRICK REYNARD, age 24; SHAYNE LEBLANC, age 40; and AKAI SULLIVAN, age 27, were charged today in a 22-count superseding indictment for violations of the Racketeer Influenced Corrupt Organization (RICO) Act, the Violent Crime in Aid of Racketeering Act, the Federal Gun Control Act, Controlled Substances Act, and obstruction of justice, announced U.S. Attorney Jim Letten. MELVIN HUDSON was already under indictment but the other 11 defendants are newly charged.

This case arises out of a joint investigation by ATF, FBI, and the Jefferson Parish Sheriff’s Office. This investigation targeted an area which exhibited a disproportionate amount of violent crimes and narcotics trafficking. During the course of the investigation, specific individuals were identified as the main perpetrators of many of the violent acts and much of the narcotics distribution. Based on this initial information, federal and local law enforcement officers interviewed witnesses, confidential informants, as well as state defendants, relative to the targeted individuals. It was revealed that a group of individuals operated in areas of Harvey Louisiana, specifically the neighborhoods known as Scottsdale and Haydel. This group controlled these areas for their narcotics distribution activities through violence and through threats of violence, to include murder, attempted murder, and assaults. They were referred to as the Harvey Hustlers and/or Murder Squad.

CBP U.S. Border Patrol Agents Seize More than 10 Tons of Marijuana

Edinburg, Texas ─ CBP U.S. Border Patrol agents from the Rio Grande Valley Sector seized more than 21,000 pounds of marijuana over the past seven days.

Agents seized one of the largest loads of marijuana in Havana, Texas, after they encountered a group of smugglers hiding bundles of marijuana in the brush near the Rio Grande. When the smugglers saw the agents they fled to Mexico. While thoroughly searching the area, agents found more than 1,300 pounds of marijuana, with an estimated value of more than $1.2 million.

Nearly 1,000 additional pounds of marijuana were confiscated in an unrelated seizure Wednesday in Sullivan City, Texas. The seizure occurred after agents received a call over the radio about a minivan that was possibly loaded with narcotics. Agents in the area saw a vehicle matching the description run a red light. Agents found the vehicle abandoned with the marijuana inside. The marijuana has an estimated value of more than $760,000.

Additional seizures from Friday through Thursday pushed the total estimated value of marijuana seized to more than $17 million. It was turned over to the appropriate agencies for further investigation.

Johnson announced that a Mission, South Dakota, man has been indicted by a federal grand jury for second-degree murder, assault with a dangerous weapon, and aiding and abetting. Ronald Dean Kills In Water, age 28, was indicted by a federal grand jury on January 18, 2012. He appeared before United States Magistrate Judge Mark A. Moreno on January 26, 2012, and pled not guilty to the superseding indictment. The maximum penalty upon conviction is life in custody, a $250,000 fine, or both. Restitution may also be ordered.

The charges are merely accusations, and Kills In Water is presumed innocent until and unless proven guilty.

The investigation is being conducted by the Federal Bureau of Investigation and Rosebud Sioux Tribe Law Enforcement Services. The case is being prosecuted by Assistant United States Attorney Tim Maher.

Kills In Water was remanded to the custody of the United States Marshal.

Arkansas Men Sentenced in Cross-Burning Case

WASHINGTON—Bradley Branscum, 23, and Tony Branscum, 26, who are first cousins, of Salado, Ark., and Curtis Coffee, 19, of Batesville, Ark., were sentenced for charges relating to their roles in burning a cross in the yard of an African-American resident on Aug. 28, 2010. Tony Branscum was sentenced on Jan. 20, 2012, to 18 months in prison. Bradley Branscum and Curtis Coffee were sentenced today. Bradley Branscum was sentenced to seven months in prison and Curtis Coffee was sentenced today to 18 months in prison.

On Aug. 28, 2010, the three men and a juvenile constructed a cross, placed it in the yard of an African-American resident of Salado, and lit it on fire. The defendants then drove away. The resident did not suffer injury, and his home was not damaged. All three men had previously pleaded guilty in this case to interfering with the housing rights of another.

“The defendants acted to instill fear because of the victim’s race,” said Thomas E. Perez, Assistant Attorney General for the Civil Rights Division. “The Department of Justice remains committed to protecting our communities from such violence and will continue to aggressively prosecute these acts.”

This case was investigated by the FBI and prosecuted by AUSA John Ray White, of the U.S. Attorney’s Office, and Trial Attorney Cindy Chung of the Civil Rights Division.

FBI and Local Law Enforcement Announce Bandit Shield Crime Initiative

AUSTIN, TX—Michael A. Clancy, Acting Special Agent in Charge of the San Antonio Division of the Federal Bureau of Investigation (FBI), and regional law enforcement announce the implementation of a new regional crime reduction venture, the Bandit Shield Initiative.

The Bandit Shield Initiative was developed to reduce bank robberies and to assist local, state, and federal law enforcement with their robbery investigations. Financial institutions participating in the Bandit Shield Initiative have agreed to implement a variety of “best practices” and other security measures developed to deter robberies in an effort to assist law enforcement. Additionally, participating financial institutions have undertaken other innovative steps as part of this initiative to make their institutions unattractive targets for would-be robbers. Banking institutions in compliance with the Bandit Shield Initiative will be provided with Bandit Shield decals to be affixed to the institution’s doors. Initially, the Bandit Shield Initiative will be implemented in FBI San Antonio’s designated area of responsibility, which includes the Austin area, and it will be considered for broader participation at a later time.

California Fugitive Returned to U.S. After Tip Leads to Capture in Belize

A fugitive wanted for a June 2010 homicide in the city of Palmdale was returned to the U.S. yesterday following her capture in Belize. Larene Eleanor Austin, 29, allegedly murdered Lanell Barsock in 2010 and attempted to frame the victim’s boyfriend for the murder.

When Los Angeles County Sheriff’s detectives determined that Austin had fled the state of California, detectives requested assistance from the Los Angeles Fugitive Task Force, and publicized the case on the television program, America’s Most Wanted.

Los Angeles County Sheriff’s detectives received a tip after the television program aired a story about the murder over the 2011 Christmas holiday. The tip indicated Austin was living in the Central American country of Belize. After further investigation, Sheriff’s detectives determined the tip was credible and shared it with members of the FBI’s Fugitive Task Force in Los Angeles.

The Fugitive Task Force contacted the FBI’s Legal Attaché in San Salvador, which covers Belize and other Central American countries, to further investigate the tip. Officers with the Belize Police Department working with FBI agents in Central America arrested Austin without incident.

Austin was expelled yesterday from Belize and was flown to Houston, Texas, under the escort of FBI agents assigned to the U.S. Embassy in San Salvador.

Arkansas Man Sentenced for His Role in the Firebombing of Interracial Couple’s Home

WASHINGTON—The Department of Justice announced today that Jason Barnwell, 37, of Evening Shade, Ark., was sentenced in Little Rock, Ark., for his involvement in firebombing the residence of an interracial couple. On Aug. 26, 2011, Barnwell pleaded guilty to conspiring to violate the civil rights of a resident of Hardy, Ark., and to using fire in the commission of that offense. Barnwell also pleaded guilty to possessing a firearm as a convicted felon. District Judge Billy Roy Wilson sentenced Barnwell to 20 years in prison for the three counts.

During his plea, Barnwell admitted that on the night of Jan. 14, 2011, he hosted a party where he and three other men—Jake Murphy, Dustin Hammond, and Gary Dodson—devised a plan to firebomb the victims’ house. The men then went to the victims’ house in Hardy and when they arrived, Barnwell, Murphy, and Hammond constructed three Molotov cocktails and threw them at the house. The Molotov cocktails ignited and damaged the victims’ house; however, the victims fortunately were not injured.

Murphy and Hammond have already pleaded guilty to civil rights violations for their role in this incident. Both defendants received sentences of 54 months’ incarceration and three years of supervised release. In June 2011, Wendy Treybig, who co-hosted the party on Jan. 14, 2011, with Barnwell, pleaded guilty to obstructing justice. She was sentenced on Dec.13, 2011, to 21 months in prison and three years of supervised release. Gary Dodson pleaded guilty on Dec.7, 2011, and will be sentenced on April 6, 2011.

“This defendant not only committed acts of race-based violence, but recruited others to commit these hate-filled crimes as well. There is no place in our society for criminal acts such as these,” said Thomas E. Perez, Assistant Attorney General for the Civil Rights Division. “The Justice Department will continue to vigorously prosecute individuals who commit such atrocious acts.”

This case was investigated by the Little Rock Office of the FBI and the Little Rock Office of the Bureau of Alcohol, Tobacco, Firearms and Explosives, with assistance from the Arkansas State Police, the Hardy and Waldron Police Departments, and the Scott and Sharp County Sheriff’s Offices. It is being prosecuted by Assistant U.S. Attorney John Ray White of the Eastern District of Arkansas, and Trial Attorneys Henry Leventis and Cindy Chung of the U.S. Department of Justice Civil Rights Division.

Capture of FBI Fugitive Esteban Ramos-Cruz

Piehota, Special Agent in Charge of the FBI’s Buffalo Office, announces this morning’s capture of Esteban Ramos-Cruz, 25 years old, a federally indicted member of the 7th Street Gang, in Springfield, Massachusetts. Ramos-Cruz has been an FBI fugitive since May 2011. He was recently profiled on an episode of America’s Most Wanted that aired on Friday, January 6, 2012, on the Lifetime Network.

On May 5, 2011, FBI Buffalo’s Safe Streets Task Force (SSTF) arrested multiple members of the 10th Street and 7th Street Gangs. Soon after, 7th Street Gang member Ramos-Cruz fled and remained an armed and dangerous fugitive until his capture this morning. Ramos-Cruz was indicted on the following federal charges: murder in aid of racketeering in connection with the murder of a 10th Street member/associate Eric Morrow; use, carry, and discharge of a firearm during a crime of violence; possession of a firearm in furtherance of a crime of violence; possession of firearms in furtherance of a drug trafficking crime; and narcotics conspiracy.

Following the profile of Ramos-Cruz on America’s Most Wanted on January 6, FBI Buffalo received a tip from an AMW viewer who relayed information that placed Ramos-Cruz in the Springfield, Massachusetts area. Further investigation by FBI Buffalo revealed a specific location for Ramos-Cruz, and this morning members of the FBI’s Western Massachusetts Gang Task Force, which is composed of the Massachusetts State Police, DEA, Hampden County Sheriff, and police from Springfield, Lee, Chicopee, and Pittsfield, along with the U.S. Marshals, arrested Ramos-Cruz.

Members of Drug Smuggling Organization Sentenced

TAMPA, FL—U.S. Attorney Robert E. O’Neill announces that earlier this week, U.S. District Judge Elizabeth A. Kovachevich sentenced Elias Estupinan Rengifo (48, Colombia, South America) to 135 months in federal prison for conspiring with others to possess with intent to distribute five or more kilograms of cocaine on board vessels subject to the jurisdiction of the United States. Rengifo pled guilty on October 12, 2011.

Rengifo had three co-conspirators—Horacio Aguirre Perea (42), Vicente Aguirre Perea (45), and Wilson Vallejo (41)—all of Colombia, South America. All three were arrested in Colombia, extradited to the United States, subsequently pled guilty to the same drug conspiracy charge, and were previously sentenced.

Horacio Aguirre Perea was arrested in Colombia on August 5, 2009 and pled guilty on October 27, 2010. On January 28, 2011, he was sentenced to 235 months in federal prison.

Vicente Aguirre Perea was arrested in Colombia on August 6, 2009 and pled guilty on January 26, 2011. On April 13, 2011, he was sentenced to 180 months in federal prison.

Wilson Vallejo was arrested in Colombia on March 16, 2010 and pled guilty on March 29, 2011. He was sentenced on June 17, 2011 to 135 months in federal prison.

According to court documents, Rengifo and his co-conspirators were knowing and willing participants in an on-going maritime cocaine smuggling organization operating along Colombia’s southern coast. Between 2005 and 2009, Rengifo and his co-conspirators organized multiple maritime cocaine smuggling trips, including: (1) the stateless go-fast vessels interdicted by the United States in the Pacific Ocean on February 19, 2005 and December 2, 2006; and (2) the stateless self-propelled semi-submersible (SPSS) vessels interdicted by the United States in the Pacific Ocean on March 1, 2008 and June 16, 2008. Coast Guard officers seized more than 1,000 kilograms of cocaine from both of the interdicted go-fast vessels. The SPSS vessels were also carrying cocaine, but were scuttled before Coast Guard officers could recover any cocaine. The mariners on the four interdicted vessels were first brought into the United States in the Middle District of Florida.

This case was investigated by OCDETF’s Panama Express Strike Force South. The strike force includes agents and analysts from the Federal Bureau of Investigation, the Drug Enforcement Administration, U.S. Immigration and Customs Enforcement, the United States Coast Guard Investigative Service, the Naval Criminal Investigative Service, and Joint Interagency Task Force South. It was prosecuted by Assistant United States Attorney Christopher F. Murray.

Five Members of the Bonanno Crime Family Arrested for Racketeering and Related Charges

Defendants Include One Current and Two Former Members of the Bonanno Crime Family Administration

A 14-count superseding indictment was unsealed this morning in Brooklyn federal court charging five members of the Bonanno organized crime family of La Cosa Nostra (the “Bonanno family”) variously with racketeering, extortion, illegal gambling, and conspiring to distribute marijuana. An associate of the Gambino organized crime family of La Cosa Nostra (the “Gambino family”) was also charged with loansharking.1 The defendants were arrested earlier today in New York and are scheduled to be arraigned this afternoon before United States Magistrate Judge Joan M. Azrack, at the U.S. Courthouse, 225 Cadman Plaza East, Brooklyn, New York. The case has been assigned to United States Chief District Court Judge Carol B. Amon.

The charges were announced by Loretta E. Lynch, United States Attorney for the Eastern District of New York; Wilbert L. Plummer, Acting Special Agent in Charge, Drug Enforcement Administration, New York Field Division; Janice K. Fedarcyk, Assistant Director in Charge, Federal Bureau of Investigation, New York Field Office; and Raymond W. Kelly, Commissioner, New York City Police Department.

As alleged in the indictment and a detention memorandum filed by the government today, defendant Vincent Badalamenti, also known as “Vinny TV,” is a made member of the Bonanno family and a current member of the family’s administration, who until his arrest, was the highest ranking member of the Bonanno family at liberty. Defendants Anthony Graziano, also known as “TG,” and Nicholas Santora, also known as “Nicky Mouth,” are captains in the Bonanno family and former members of the Bonanno family administration. Defendant Vito Balsamo is an acting captain in the Bonanno family, and defendant Anthony Calabrese is a soldier in the Bonanno family. The indictment is the result of a multi-year joint investigation by the DEA and FBI that utilized a variety of techniques to gather evidence, such as consensual recordings of the defendants discussing their charged crimes, cooperating witnesses who were formerly members and associates of organized crime, and surveillance. The evidence revealed a pattern of violence and intimidation employed by the defendants to further their enterprise’s economic interests, including Badalamenti allegedly directing the hostile takeover of a bar located on Coney Island Avenue in Brooklyn, as a result of its owner’s failure to repay a debt owed to Badalamenti.

The charges in the indictment also demonstrate the recidivist nature of organized crime defendants. For example, as detailed in the government’s detention memorandum, Santora allegedly participated in his charged crimes following his prior conviction and incarceration, and while released on supervised release, and Graziano allegedly committed his charged crimes within weeks of being released to a federal halfway house. During one consensual recording, a cooperating witness (“CW”) told Graziano that during Graziano’s most recent prison term, the CW was sent to collect money from one of Graziano’s loanshark victims who “was crying hysterical.” The CW and Graziano also discussed how the CW was sent on multiple occasions to collect money from the same victim by a member of the Bonanno family’s ruling panel, to which Graziano responded, “Yeah, well, he was trying to collect my money.” On another occasion, Graziano allegedly directed the CW to meet a second extortion victim and “open him up.”

The charges and arrests announced today are the latest in an ongoing investigation that has resulted in the prosecution of more than 175 members and associates of the Bonanno family in the Eastern District of New York. Since March 2002, more than 10 Bonanno family bosses, acting bosses and administration members have been convicted in this district on racketeering and racketeering-related charges.

“Members of organized crime continue to exploit their victims the old-fashioned way—through violence, threats, and intimidation. Learning nothing from their incarceration, two of the defendants allegedly sought to regain their money and influence on the street while still under federal supervision. But because they learned nothing, they find themselves back in custody again, along with their co-defendants,” stated United States Attorney Lynch. “As law enforcement has so successfully done before, we will employ our own time-tested techniques to bring them to justice to account for their crimes. We will not rest in this pursuit until the Bonanno crime family and La Cosa Nostra have been completely dismantled.”

DEA Acting Special Agent in Charge Plummer stated, “These arrests prove that justice comes to those who have abused the system. The five defendants arrested with RICO charges will face the consequences of their alleged illegal actions in the court of law. The New York Drug Enforcement Task Force worked diligently with the United States Attorney’s Office in order to keep our city and state crime free.” Mr. Plummer thanked the New York Drug Enforcement Task Force which comprises agents and officers of the DEA, New York State Police and the New York City Police Department for their hard work on this investigation.

FBI Assistant Director in Charge Fedarcyk stated, “Today’s charges confirm that La Cosa Nostra families continue to engage in the bedrock money-making activities like extortion and loansharking, and are not shy about resorting to violence as a method. As long as mobsters continue their predatory ways, the FBI will continue to target the mob.”

NYPD Commissioner Kelly stated, “This case demonstrates that the FBI, DEA, and NYPD in partnership with federal prosecutors, are relentless and will continue to dismantle organized crime and protect the public from its insidious effects.”

If convicted, each defendant faces a maximum sentence of 20 years’ imprisonment.

The government’s case is being prosecuted by Assistant United States Attorneys Nicole M. Argentieri and Stephen E. Frank.

How a Memphis Task Force Combats a Costly Problem

After many hours on the road, the long-haul driver pulled his tractor-trailer into a Tennessee truck stop for a break and a hot meal. But by the time he looked over the menu, a crew of professional thieves had made off with his rig and all its contents.

Cargo theft is a multi-billion-dollar criminal enterprise in the U.S., and the FBI has seven task forces located around the country to combat the problem. In the Memphis region, according to Special Agent Conrad Straube, coordinator of the Memphis Cargo Theft Task Force, “there is an average of one cargo theft every day of the year.”

Memphis—located along major interstate highways and home to a variety of product distribution centers—is a hot spot for cargo theft. The thieves steal trucks with trailers or just the trailers and their contents. Often, goods are stolen from distribution center warehouses or even from moving rail cars.

On a recent day, Straube and his task force partners from the Memphis Police Department, Shelby County Sheriff’s Office, and the U.S. Marshals Service were on the road, following up on leads at truck stops and other locations in and around Memphis. The task force is busy—and successful. From January 2011 to the end of September, it recovered more than $1.5 million in stolen cargo and vehicles.

Task force member Barry Clark, a detective with the Shelby County Sheriff’s Office, explained that some of the theft crews are so organized that each member has his own specialty, from the break-in artist who can steal a rig in seconds to professional drivers, surveillance experts, and the guys who know how to defeat the specialized devices that lock trailers carrying extremely valuable loads. “This is their business,” Clark said. “And they are good at it.”

Crew leaders know where to find willing buyers, too—from small mom and pop stores who don’t ask questions when they buy at prices below wholesale to online merchants who may or may not know they are purchasing stolen goods.

Although many crews target specific cargo such as electronics and pharmaceuticals—always in demand and easy to sell—other thieves steal whatever they can get their hands on. Straube and his team have recovered stolen trailers full of dog food, hair dryers, lawn mower engines, and even popsicles.

“When you talk about the victims of cargo theft,” Straube explained, “beyond the trucking companies and manufacturers, you have to include all consumers. Because when these items are stolen, it eventually drives up the cost of merchandise for everybody.”

Cargo theft is also a “gateway” crime, said Special Agent Eric Ives, a program manager in our Criminal Investigative Division at FBI Headquarters who coordinates major theft investigations from a national perspective. “Groups that do these crimes are often funding other illegal activities, like buying drugs or weapons. And compared to many crimes,” Ives added, “cargo theft is highly profitable and not particularly dangerous.”

Conrad agreed, adding that thieves often rob warehouses on a Friday night, and by the time the crime is discovered and reported Monday morning, the stolen merchandise may already be on a store shelf or auctioned online.

That’s why our task forces—comprised of local, state, and federal law enforcement—and our partnerships with private industry (see sidebar) are critical in the fight against these costly crimes, Ives said. “Cargo theft is a sophisticated and organized enterprise,” he added, “and we take this threat very seriously.”

Partnerships Make a Difference

In 2005, two large pharmaceutical companies were the victims of major cargo thefts at the same truck stop within a short time period, and each had no idea what had happened to the other. When they found out later, a meeting was called among pharmaceutical industry leaders, and the concept of a security coalition was born. The coalition would consist not only of industry members but also law enforcement.

Today, the Pharmaceutical Cargo Security Coalition shares information about thefts and best practices for reducing risk, according to Charles Forsaith, director of supply chain security for Purdue Pharma Technologies, who coordinates the coalition.

“We educate everyone in our industry,” said Forsaith, “and we work together with law enforcement to stop these crimes. That partnership has yielded a measurable decline in cargo theft.”

In 2008, for example, the pharmaceutical industry reported losses of 16 full trailer loads each valued in excess of $1 million. In 2011, Forsaith said, there were only four such losses valued over $1 million. In 2008, the odds of recovering a lost load were 31 percent. Today, he said, with the help of GPS tracking devices and a strong working relationship with law enforcement, the odds for recovery are better than 65 percent.

“We realized that we couldn’t put a stop to these crimes on our own,” he said. “In addition to educating our industry, we knew we needed buy-in from law enforcement, and we have been extremely pleased working with the FBI’s cargo theft task forces.”

Federal Indictment Charges 15 Men from Albuquerque and Edgewood with Drug Trafficking and Financial Crimes

ALBUQUERQUE—A 29—count federal indictment charging 15 men from Albuquerque and Edgewood, N.M., with drug trafficking, money laundering, and currency structuring charges was unsealed late yesterday afternoon, announced U.S. Attorney Kenneth J. Gonzales; Joseph M. Arabit, Special Agent in Charge of the El Paso Field Division of the Drug Enforcement Administration (DEA); Carol K.O. Lee, Special Agent in Charge of the Albuquerque Division of the Federal Bureau of Investigation (FBI); and Dawn Mertz, Special Agent in Charge of the Phoenix Division of the Internal Revenue Service, Criminal Investigation (IRS).

The indictment is the result of a multi-agency investigation into a major drug trafficking and money laundering organization operating out of the Albuquerque metropolitan area that was designated as part of the Organized Crime Drug Enforcement Task Force (“OCDETF”) program. OCDETF is a nationwide Department of Justice program that combines the resources and unique expertise of federal agencies, along with their local counterparts, in a coordinated effort to disrupt and dismantle major drug trafficking organizations.

Yesterday, a team of federal, state, and local law enforcement officers arrested nine of the 15 defendants named in the indictment, and executed 10 search warrants at residences in Albuquerque and a ranch in Edgewood. Those arrested include Steve Chavez, 32, a fireman with the Albuquerque Fire Department. Two other defendants, Jesus Ramos Castillo, 29, and Gabriel Guerra-Gonzalez, 27, both Mexican nationals, are in state custody on pending local charges; they will be transferred to federal custody to face the charges in the indictment. The defendants arrested yesterday are scheduled to make their initial appearances in federal court in Albuquerque this morning.

Four defendants, Homero Varela, 29, Manuel Villa-Mayorquin, 23, and Procoro Noberto-Alvarez, 28, Mexican nationals, and Ramon Gonzalez, Jr., 25, of Edgewood, have yet to be arrested and are considered fugitives.

The indictment alleges that, between May 2011 and January 2012, all 15 defendants participated in a conspiracy to distribute controlled substances, including cocaine, methamphetamine and marijuana. Each defendant also is charged with using communication devices to facilitate drug trafficking crimes (sometimes referred to as “phone counts”), and Homero Varela is charged with distributing methamphetamine on three separate occasions over a three month period. The maximum penalties for a conviction on the conspiracy charge and each of the three methamphetamine distribution charges is a minimum 10 years’ to a maximum of life imprisonment and a $10 million fine, and the maximum penalty for a conviction on each of the phone counts is four years of imprisonment and a $250,000 fine.

The indictment also charges Homero Varela, Roy Madrid, 21, of Albuquerque, and Manuel Villa-Mayorquin with conspiracy to launder money. Homero Varela is further charged with an additional count of money laundering involving drug proceeds. A conviction on the money laundering conspiracy carries a maximum penalty of 20 years of imprisonment, and a conviction on the substantive money laundering charge carries a maximum penalty of ten years of imprisonment and a $250,000 fine.

Ramon Gonzalez, Jr., is charged with seven counts of structuring financial transactions to avoid certain reporting requirements for an aggregate of $166,300 through 24 transactions between April 2009 and August 2011. Steve Chavez is charged with structuring an aggregate of $348,500 in 37 transactions between July 1, 2011 and August 25, 2011. The maximum penalty for a conviction on each of these counts is five years of imprisonment and a $250,000 fine.

The indictment also seeks forfeiture of property constituting, or derived from proceeds obtained directly, or indirectly, from the defendants’ illegal drug trafficking and financial crimes, including three Albuquerque residences owned, occupied or in the possession of Homero Varela, Ramon Gonzalez, Sr., and Steve Chavez, respectively, and a ranch in Edgewood owned by Ramon Gonzalez, Sr. It also seeks forfeiture of funds in numerous bank accounts in the names of Homero Varela, Ramon Gonzales, Sr., Ramon Gonzalez, Jr., Andres Gonzalez and Steve Chavez, as well as a money judgment of at least $15,000,000, the amount of money allegedly derived or involved in the offenses alleged in the indictment.

During yesterday’s law enforcement operation, officers seized a half kilogram of cocaine, more than 10 pounds of high grade marijuana, approximately $25,000 in cash, 20 vehicles, seven handguns, nine rifles, and two shotguns.

In announcing yesterday’s arrests, U.S. Attorney Gonzales said, “The charges in this indictment are some of the most significant drug and money laundering charges ever filed in the District of New Mexico. The investigation that led to this indictment exemplifies the law enforcement cooperation that we are fortunate to experience here in New Mexico. Federal, state and local officers worked long and hard and side-by-side in a coordinated effort to arrest numerous individuals charged in the indictment. We owe a debt of gratitude to everyone involved in the investigation. Their efforts have made our streets and communities much safer.”

“The Varela organization has been responsible for distributing multi-kilogram quantities of cocaine, marijuana, and methamphetamine in central and north central New Mexico,” said DEA Special Agent in Charge Arabit. “DEA and our federal, state, county, and municipal law enforcement partners have worked hand-in-hand to disrupt this organization from its roots, culminating in the indictment of 15 of its members of which 11 are in custody and the seizure of their drugs and assets, including 20 vehicles, 18 weapons, cash, and real property. Through these enforcement actions, we are making our communities safer.”

The case is being prosecuted by Assistant U.S. Attorneys Reeve Swainston and Samuel L. Hurtado, and was investigated by DEA, FBI, and IRS with support from the New Mexico State Police, the Albuquerque Police Department, the El Paso County Sheriff’s Office, and the Corrales Police Department. Homeland Security Investigations, the U.S. Marshal’s Service, the U.S. Border Patrol, the Bernalillo County Sheriff’s Office, the Air Branch of U.S. Customs and Border Protection, the New Mexico Department of Public Safety Motor Transportation Police Division, and the Region II HIDTA Task Force participated in yesterday’s law enforcement operation.

Charges in indictments are only accusations. All criminal defendants are presumed innocent unless proven guilty beyond a reasonable doubt.

Peach Springs Man Indicted on Assault and Firearm Charges

PHOENIX—On January 24, 2012, a federal grand jury in Phoenix, Arizona returned a five-count indictment against Cooper Price Susanyatame, 19, of Peach Springs, Arizona. The indictment charges Susanyatame with violations of assault with a dangerous weapon, assault resulting in serious bodily injury, use of a firearm in a crime of violence, and possession of an unregistered firearm.

The allegations in the indictment stem from the previously filed complaint, which alleges that on December 25, 2011, on the Hualapai Nation Indian Reservation, Susanyatame fired a short-barreled .22 caliber rifle through the window of a neighboring home. The complaint alleges that, although the bullet missed a juvenile victim who was playing outside near the window at the time Susanyatame shot the gun, the bullet struck an adult victim in the back of the head while she was standing in a hallway inside the home. The adult victim was airlifted to a Las Vegas Hospital, where the bullet was extracted from her scalp.

Convictions for the assault and unregistered firearm offenses carry a maximum penalty of 10 years in prison, a $250,000 fine or both. A sentence for use of a firearm in a crime of violence must run consecutive to any other sentence, with a maximum penalty of life imprisonment. In determining an actual sentence, Judge Paul G. Rosenblatt will consult the U.S. Sentencing Guidelines, which provide appropriate sentencing ranges. The judge, however, is not bound by those guidelines in determining a sentence.

The investigation preceding the indictment was conducted by the Federal Bureau of Investigation and the Hualapai Nation Police Department. The prosecution is being handled by Tracy Van Buskirk, Assistant U.S. Attorney, District of Arizona, Phoenix.

Suspect Arrested After Allegedly Robbing Two New York Banks

Early this morning, Burchard Bertrand was arrested without incident by FBI agents and NYPD detectives at his apartment in Ozone Park, New York, for allegedly robbing two New York-area banks. He was being sought by the FBI for allegedly robbing a Chase Bank branch at 96-19 101st Avenue in Ozone Park on December 23, 2011, and another Chase Bank branch at 391 Eastern Parkway in Brooklyn on January 3, 2012.

He will be arraigned later today in federal court in the Eastern District of New York on federal bank robbery charges.

U.S. Attorney for District of Colorado Sends Letters to 23 Marijuana Dispensaries Within 1,000 Feet of Schools Warning Them to Shut Down or Face Federal Enforcement Action

DENVER – U.S. Attorney John Walsh today issued letters to 23 marijuana stores, formally notifying them that action will be taken to seize and forfeit their property if they do not discontinue the sale and/or distribution of marijuana within 45 days from today, January 12, 2012. Those who do not comply will be subject to potential criminal prosecution and civil enforcement actions by the United States Attorney’s Office for the District of Colorado and the Drug Enforcement Administration (DEA). The 23 stores, located in various cities and towns around the state, are each within 1,000 feet of a school. Many are far closer.

Because the stores are operating within 1,000 feet of a school, enhanced penalties apply under federal law. See 21 U.S.C. § 860(a).

“When the voters of Colorado passed the limited medical marijuana amendment in 2000, they could not have anticipated that their vote would be used to justify large marijuana stores located within blocks of our schools,” said U.S. Attorney John Walsh. He noted that data shows that since the opening of marijuana dispensaries in Colorado in 2010, many school districts in Colorado have seen a dramatic increase in student abuse of marijuana, with resulting student suspensions and discipline.

The United States Attorney’s Office and its law enforcement partners continue to work to identify marijuana stores within 1,000 feet of schools. As a result, today’s letters are merely a first step to address this issue, and the office will continue to insist marijuana stores near schools shut down.

The Department of Justice has earlier provided U.S. Attorneys with guidance in the form of a memo written by then Deputy Attorney General David Ogden in 2009, later amplified by Deputy Attorney General James Cole in 2011. Those memos address resource issues and set forth parameters for individual U.S. Attorneys to exercise their discretion to handle marijuana trafficking matters, including marijuana trafficking near schools. Today’s action is pursuant to and consistent with the guidance given by the Department of Justice in these memos.

Two More Defendants Sentenced in Florida Pill Mill Operation

Additional Defendants Sentenced in Broward and Palm Beach Counties in Operation Oxy Alley

Jan 20 – Miami – Mark R. Trouville, Special Agent in Charge, Drug Enforcement Administration (DEA), Miami Field Division; Wifredo A. Ferrer, United States Attorney for the Southern District of Florida; John V. Gillies, Special Agent in Charge, Federal Bureau of Investigation (FBI), Miami Field Office; and José A. Gonzalez, Special Agent in Charge, Internal Revenue Service, Criminal Investigation Division (IRS-CID), announced the sentencing of two additional defendants in connection with charges stemming from Operation Oxy Alley, a coordinated investigation into pill mills in Broward and Palm Beach Counties.

Including the two defendants sentenced today, 13 defendants have been sentenced to date on an indictment unsealed on August 23, 2010, which charged 32 defendants. The indictment alleged that defendants Christopher and Jeffrey George, twin brothers, operated, managed and financed four pain management clinics in Broward and Palm Beach Counties. According to the indictment and statements made in court, from 2008 to early 2010, these pill mills distributed approximately 20 million oxycodone pills and made more than $40 million from the illegal sales of controlled substances. Thirteen of the thirty-two defendants were doctors.

U.S. District Judge Kenneth A. Marra sentenced two defendants, both of whom had previously pled guilty in September and October 2011. Christopher Hutson, 31, of Wellington, pled guilty to one count of racketeering conspiracy and Christine Chico-Blume, a doctor, 59, of Jupiter, pled guilty to one count of conspiracy to commit money laundering. Christopher Hutson was sentenced to 108 months in prison, to be followed by one year of supervised release. Christine Chico-Blume was sentenced to 60 months in prison, to be followed by one year of supervised release.

At present, 28 of the 32 defendants named in the indictment have pleaded guilty, including clinic owners Christopher and Jeffrey George. The sentencing hearings are scheduled to continue throughout January and February 2012.

The investigation and prosecution were the result of work by federal, state and local law enforcement agencies. DEA, FBI, IRS-CID were assisted by the Palm Beach County Sheriff’s Office, the Broward Sheriff’s Office, the Hollywood Police Department, the Boca Raton Police Department, and the Davie Police Department. Coordination efforts also included cooperation by the Palm Beach State Attorney’s Office as well as contributions by the Delray Beach Police Department, Jupiter Police Department, West Palm Beach Police Department, Boynton Beach Police Department, Medley Police Department, Homestead Police Department, North Miami Beach Police Department, and Sunny Isles Police Department.

Arkansas Men Sentenced in Cross-Burning Case

WASHINGTON – Bradley Branscum, 23, and Tony Branscum, 26, who are first cousins, of Salado, Ark., and Curtis Coffee, 19, of Batesville, Ark., were sentenced for charges relating to their roles in burning a cross in the yard of an African-American resident on Aug. 28, 2010. Tony Branscum was sentenced on Jan. 20, 2012, to 18 months in prison. Bradley Branscum and Curtis Coffee were sentenced today. Bradley Branscum was sentenced to seven months in prison and Curtis Coffee was sentenced today to 18 months in prison.

On Aug. 28, 2010, the three men and a juvenile constructed a cross, placed it in the yard of an African-American resident of Salado and lit it on fire. The defendants then drove away. The resident did not suffer injury, and his home was not damaged. All three men had previously pleaded guilty in this case to interfering with the housing rights of another.

This case was investigated by the FBI and prosecuted by AUSA John Ray White, of the U.S. Attorney’s Office and Trial Attorney Cindy Chung of the Civil Rights Division.

Nevada Man Dubbed the “Fedora Bandit” is Charged with Serial Bank Robbery

SACRAMENTO, CA—United States Attorney Benjamin B. Wagner announced today that David Griffith Osborne, 74, of Carson City, Nev., was charged by felony complaint on Tuesday with seven counts of armed bank robbery in the Eastern District of California.

The case is the product of an investigation by the FBI with the assistance from police departments in Grass Valley, South Lake Tahoe, Gridley, and Paradise; the Sheriff’s Offices in Placer and Sacramento Counties; and the Carson City Sheriff’s Office. It was the collaborative effort and cooperation of the agencies involved in the investigation that ultimately led to Osborne’s identification and the filing of federal charges. Assistant U.S. Attorney Michelle Rodriguez is prosecuting the case.

According to the complaint, Osborne robbed the following California banks:

■December 22, 2009, Bank of the West, 736 Taylorville Road, Grass Valley;

■February 18, 2010, Bank of the West, 2160 Lake Tahoe Boulevard, South Lake Tahoe;
■March 9, 2010, Bank of the West, 200 Bear Street, Kings Beach;
■March 31, 2010, Bank of the West, 736 Taylorville Road, Grass Valley;
■April 26, 2010, Bank of the West, 34 East Gridley Road, Gridley;
■June 3, 2010, American River Bank, 9750 Business Park Drive, Rancho Cordova;
■June 29, 2010, Chase Bank, 6669 Clark Road, Paradise.

In addition, according to court documents, Osborne also committed the April 12, 2010 armed robbery of the Bank of the West’s Carson City branch at 2976 North Carson Street in Nevada.

Osborne is currently in federal custody on unrelated charges. He faces up to 25 years in federal prison for each armed bank robbery. The actual sentence, however, will be determined at the discretion of the court after consideration of any applicable statutory sentencing factors and the Federal Sentencing Guidelines, which take into account a number of variables.

The charges in the complaint are only allegations, and the defendant is presumed innocent until and unless proven guilty beyond a reasonable doubt.

Robbery of Century Bank Branch in Santa Fe

The FBI and Santa Fe Police Department are investigating a bank robbery that occurred Thursday (1/26/2012) at Century Bank, 1790 St. Michael’s Dr., in Santa Fe.

The male suspect wore a black ski mask, a tan or dark jacket, and pants. He is about 5’7” to 6’ tall and had a small to medium build.

Witnesses say the suspect walked into the bank at about 10:30 a.m. and used a handgun to demand money.

The suspect left with an undisclosed amount of money.

Bank robbery is punishable by a 20-year prison sentence for each offense and the penalty increases if a dangerous weapon is used in the commission of the crime.

Extradition of Fugitive Oscar Martinez-Hernandez from Venezuela

SAN JUAN, PR—Today, Oscar Martínez-Hernández, also known as “Cali,” age 39, was extradited from Venezuela to Puerto Rico. On January 4, 2012, Martínez-Hernández was arrested by Venezuelan law enforcement authorities in the city of Maracaibo, Venezuela. Martínez-Hernández is being extradited based on an INTERPOL Red Notice which was issued in an attempt to locate him.

Martínez-Hernández has been a fugitive for the past 12 years, when he fled awaiting a jury verdict on state murder and weapons charges. On July 15, 1999, he was sentenced in absentia to life imprisonment by the Commonwealth of Puerto Rico. Martínez-Hernández is one of the Police of Puerto Rico’s Ten Most Wanted Fugitives.

In addition, Martínez-Hernández is the subject of four separate set of federal charges issued by a federal grand jury (FGJ) from the District of Puerto Rico. These charges are as follows:

■In March 1994, a FGJ charged Martínez-Hernández with possession with intent to distribute heroin and cocaine.

■In November 1999, a FGJ charged Martínez-Hernández with possession with intent to distribute cocaine.
■In May 2001, a FGJ charged Martínez-Hernández with allegedly importing approximately 780 kilograms of cocaine from South America to the United States.
■In June 2011, a FGJ charged Martínez-Hernández for allegedly being the leader and supplier, as well as the individual who oversaw the transportation of multi-kilogram quantities of narcotics.

These cases are being prosecuted by Assistant United States Attorneys George A. Massucco, Carmen Marquez, Jenifer Y. Hernández and Myriam Y. Fernández.

The successful capture of this fugitive was primarily based upon a collaborative effort by the FBI, DEA, U.S. Marshals Service, the Diplomatic Security Service, and the U.S. Immigration and Customs Service (ICE).

“The arms of justice are long and world-wide; thanks to our international law enforcement partners. No matter how much time and effort it takes, these individuals who try to flee will eventually be apprehended and face justice for their crimes,” said Joseph S. Campbell, Special Agent in Charge of the FBI-San Juan Field Office.

“Puerto Rico’s Police Department continues to work hand in hand with all local, state and federal security agencies, in order to ensure and provide our communities with greater public safety. Martínez-Hernández has been a fugitive for the past 11 years, and, because of his drug distribution activities, has caused violence, bloodshed, and terror in the streets of Puerto Rico. This sends a clear message to all fugitives that no matter how long it takes, we will not rest until they are brought to justice,” said Pedro Janer, Acting Special Agent in Charge of the DEA-Caribbean Field Office.

The public is reminded a criminal indictment contains only charges and is not evidence of guilt. A defendant is presumed to be innocent until and unless proven guilty. The U.S. government has the burden of proving guilt beyond a reasonable doubt.

FBI Seeks Female Bank Robbery Suspect

On January 26, 2012, at approximately 11 a.m., a bank robbery occurred at North Star Bank which is located at 1820 North Lexington Avenue, Roseville, Minnesota. The robber, who was described as a white female, entered the bank and approached the teller counter. She handed the victim teller a note demanding cash. After receiving an undisclosed amount of cash, the robber fled from the bank.

The robber was described as a white female, approximately 5’4” in height, with a thin build. She was wearing a three-quarter length coat, blue jeans, a dark “hoodie” sweatshirt over a dark cap with a brim, and dark fabric gloves. She was also described as having pale skin and a “facial bandage” which covered approximately 50 percent of her face.
